The following criteria shall apply as guidelines to the discretionary review of applications to establish second-hand stores subject to a conditional use permit in the C-2 zone:
A. Second-hand stores shall be allowed only if they have an appearance and are operated in a manner compatible with a thriving, stable and attractive commercial district conducive to retail shopping;
B. Second-hand stores shall utilize marketing and merchandise display techniques generally comparable to those used by retail stores selling only new merchandise. To evaluate this criteria, plans including, but not limited to, an interior layout and design plan, building elevations, sign plan, window display plan, and an exterior and an interior lighting plan shall be submitted with the conditional use permit application;
C. All merchandise, except for items such as furniture and large appliances shall be displayed on standard retail shelves and/or racks, and all merchandise shall be kept in a neat and organized manner;
D. In order to avoid an over-concentration of second-hand stores in any one area of the C-2 zone, second-hand stores shall generally be separated from one another by a distance of at least one thousand feet.
E. Six months after a CUP has been issued and a second-hand store has commenced operation, the city staff shall conduct a review of the business to ensure its compliance with the zoning code and the conditions of its use permit.

Creation of an Emergency Shelter Overlay Zone with a specific area of the City where an emergency shelter is permitted by right within the underlying M-1 zone.
Body art establishment shall not be located within five hundred feet of another existing body art establishment, and shall not be located within one thousand feet of the following sensitive uses: a single-family detached dwelling; public or private elementary, intermediate, or high school; places religious assembly; libraries; public parks; or any city-owned facility.
Establishment of a cannabis cultivation site, cannabis manufacturing site, cannabis testing laboratory, cannabis distributor, or cannabis delivery-only retailer, or any combination of the foregoing, is subject to the approval of a development agreement by the city, a conditional use permit, and the provisions of Chapter 5.90 and Title 17.
Cannabis distributors shall only be allowed by operators of a cultivation site, cannabis manufacturing site, cannabis testing laboratory (unless prohibited by state law), or delivery-only retailer that has been approved by the city pursuant to this title and Chapter 5.90. No establishments engaging exclusively in distribution activities shall be permitted.
