2.28.010 - Composition—Appointment of members.

Effective June 30, 2001, the cultural, arts and recreation commission shall consist of seven members appointed by the mayor with the approval of the council. Two non-voting members shall be students (fourteen through nineteen years of age) residing within the Fillmore Unified School District boundary.

2.28.020 - Terms.

Of the CAR commission first appointed, two shall be appointed for terms of four years, two shall be appointed for terms of two years, and one shall be appointed for the term of three years. Their successors shall be appointed for terms of four years. The student's terms shall be one-year terms, expiring annually on June 30. Any appointment to fill a vacancy occurring during the term of office of a commissioner shall be for the unexpired portion of that commissioner's term.

2.28.025 - Absence from meetings.

In the event a member of the commission does not attend two consecutive meetings during a period of two months, unless excused for cause by the chairman of the commission, the office of such member shall be deemed to be vacant and the term of such member ipso facto terminated. The secretary of the commission shall immediately notify the mayor of such termination.

2.28.028 - Vacancy on commission.

If a vacancy shall occur otherwise than by the expiration of the term, it shall be filled by appointment for the unexpired portion of the term. Any vacancy created by absence shall be filled for the unexpired term as in other instances. All appointments to fill vacancies or for a new term shall be made by the mayor with the approval of the council. Any appointee member of the cultural, arts and recreation commission may be removed by the council by a majority vote.

2.28.030 - Residency requirements.

A minimum of four members of the cultural, arts and recreation commission shall be residents of the city. No more than one member may be a resident of any incorporated or unincorporated part of the county of Ventura. The students shall reside within the Fillmore Unified School District boundary.

2.28.040 - Officers.

Officers of the cultural, arts and recreation commission shall be a chairperson and a vice-chairperson. The city clerk shall be ex officio secretary, but shall not be a member of the commission. The officers of the parks and recreation commission shall be elected annually in July by the members of the commission and shall serve one-year terms.

2.28.050 - Committee appointments.

The cultural, arts and recreation commission may create such committees as it deems necessary to the performance of its duties, and may delegate to such committees such investigation, studies, and other work as it deems advisable.

2.28.060 - Meetings—Rules adoption—Quorum.

The cultural, arts and recreation commission shall meet regularly at least once each calendar month, at a time and place determined by its members. The commission shall adopt such by-laws, rules and regulations as it finds necessary to the performance of its duties. Any three voting members shall constitute a quorum for the transaction of business, and a simple majority shall be necessary to perform any official act.

2.28.070 - Duties.

The parks and recreation commission shall:

(1) Advise and assist the council in all matters pertaining to public parks and recreation;

(2) Advise and aid the city manager or his or her designee, conducting recreational activities within the city;

(3) Recommend policies and plans for the care and conduct of all public parks now or hereafter owned or operated by the city;

(4) Advise upon request, the city planning commission regarding provision for parks and parkways in development plans for the city;

(5) Plan for, study and recommend to the city council the site location, acquisition, development and maintenance of public park and recreational facilities;

(6) Oversee the development of a city cultural arts master plan at the direction of the city council;

(7) Publicize art opportunities;

(8) Encourage artistic talent in a wide variety of forms;

(9) Interpret the community's diverse interests in the arts and striving to meet those needs;

(10) Coordinate art resources for the community and artists;

(11) When requested by the city council, commission and place public art in the city;

(12) Promote the arts as a reflection of the historical nature of the community;

(13) Elevate the city's commitment to the overall enhancement of its cultural life to co-equal status with recreation, planning, human services and youth;

(14) Provide expertise in the area of public art and in-depth knowledge of the fine and performing arts;

(15) Work cooperatively with the organizational structure of the city and all city departments;

(16) Act as a resource in areas related to public art and the arts in general;

(17) Serve as a review board for requests for funding for arts-related city-sponsored grants programs;

(18) As directed by city council, sponsor, alone or in cooperation with other public or private agencies and/or individuals, programs to further the development and public awareness of, and interest in, the fine and performing arts; and

(19) Solicit funding from private, local, state, and federal sources available for the fine and performing arts.

2.28.080 - Removal of members.

Commission members may be removed from office, upon the recommendation of any member of the city council, and with the concurrence of a majority of the city council, for breach of duty, for conduct unbecoming a public official of the city, for violation of the city's code of ethics, or for any cause deemed warranted by a majority of the city council.
