Sec. 2.6. - Generally.¶
For the orderly administration of the affairs of the government of the city and the efficient and coordinated functioning thereof, the departments enumerated in this article are created and established.

Sec. 2.7. - Department of finance—Created; scope; director.¶
There is hereby created a department of finance which shall have general direction and supervision of all of the financial affairs of the city. This department shall be in charge of a director of finance who shall be either the city administrator or a person appointed by him.

Sec. 2.8. - Same—Powers and duties of director of finance.¶
The director of finance is the chief accounting officer of the city and shall have charge of the administration of the financial affairs of the city under the direction of the city administrator. The director of finance shall be ex officio tax collector and license collector of the city. The director of finance shall perform the following duties:
a. Maintain a general accounting system for the city and each of its offices, departments and agencies.
b. Require reports of the receipts and disbursements from each receiving and disbursing agency of the city government to be made at such intervals as may be required.
c. Submit to the city administrator a monthly statement of all receipts and disbursements in sufficient detail to show the exact financial condition of the city; and submit to the city administrator at the end of each fiscal year a complete financial statement and report for the preceding year.
d. Collect all taxes, utility charges, license fees and other revenues of the city, or for whose collection the city is responsible, and receive all taxes and other money receivable by the city.
e. Supervise the keeping of current inventories of all property of the city.
f. Perform such other duties as the city administrator may direct.

Sec. 2.8-1. - Same—Transfer of certain duties from city clerk to director of finance.¶
Pursuant to the provisions of section 37209 of the Government Code of the state, the duties imposed upon the city clerk by sections 37201 through 37208, inclusive, of the Government Code of the state are hereby transferred to the director of finance. Before entering upon such duties the director of finance shall execute a bond pursuant to the provisions of section 36518 of the Government Code of the state.
Pursuant to the provisions of section 40805.5 of the Government Code of the state, the financial and accounting duties imposed upon the city clerk by sections 40802 through 40805, inclusive, of the Government Code of the state are hereby transferred to the director of finance.

Sec. 2.9. - Department of law—Created.¶
There is hereby created a department of law for the administration of legal affairs of the city.

Sec. 2.10. - Same—City attorney.¶
The supervision and direction of the department of law shall be under a director who shall be designated as the city attorney. He shall be charged with the general direction and supervision of the legal affairs and legal work of the city. He shall be appointed by the city council and be responsible to the city council.

Sec. 2.11. - Department of public safety—Created; supervision, etc.¶
There is hereby created a department of public safety. Included in the department of public safety shall be the police department and the fire department. The affairs and operation of the department of public safety shall be under the immediate supervision of the city administrator.

Sec. 2.12. - Same—Police and fire departments.¶
For the purpose of the administration of the affairs of the department of public safety it is divided into the two following sections:
(a) The police department, whose duties in general shall be to enforce the laws and ordinances relating to public peace, health and safety.
(b) The fire department, whose duties in general shall be to enforce all the laws, ordinances and regulations relating to fire hazards and to protecting persons and property from fire and the hazards of fire.

Sec. 2.12-1. - Consolidation of police and fire departments—Voter approval required.¶
Any or all existing, immediate or future administrative processes and/or proposals for the consolidation of the police and fire departments of the city of Brawley to form a public safety department, or any other consolidated department, whether proposed by the mayor, city council or city manager, shall be submitted to the voters for their approval; a two-thirds majority being necessary for the adoption and implementation of any consolidation.

Sec. 2.13. - Department of public service—Created; scope, director.¶
There is hereby created a department of public service which shall embrace the superintendence and construction and maintenance of public improvements including streets, alleys, sewers, public buildings, building permits and inspection and operation of the water system. This department shall be in charge of a director of public service who shall be appointed by and hold his office at the pleasure of the city administrator and be under the direct supervision of the city administrator.

Sec. 2.14. - Same—Administration; establishment of offices.¶
For the purpose of the orderly administration and affairs of the department of public service the following offices are established:
(a) A city engineer, who shall be in charge of performing all engineering services, construction of public works and related work.
(b) A superintendent of streets, who shall be in charge and control of the maintenance, cleaning and care of all streets, alleys, gutters, parkways, storm sewers, sanitary sewers, street lights and lighting.
(c) A superintendent of water system, who shall have charge of the physical operation of the water system.
(d) A building inspector, who shall be in charge of the issuing of all building permits, inspection of all construction, including electric wiring, plumbing, and seeing that same comply with all laws and ordinances relating to construction, plumbing, wiring, heating, zoning and public health.

Sec. 2.15. - Department of parks and recreation—Created; scope; director.¶
There is hereby created a department of parks and recreation, which shall operate the public parks and the public recreation of the city and the maintenance of same. This department shall be in charge of a director of parks and recreation who shall be appointed by and hold office at the pleasure of the city administrator.

Sec. 2.16. - Same—Administration; creation of offices.¶
For orderly administration and proper functioning of the affairs of the department of parks and recreation there is hereby created the following offices:
(a) A superintendent of parks, who shall be in charge of all the public parks and parkways belonging to or under the control of the city and their proper improvement, maintenance and operation.
(b) A director of recreation, who shall be in direct charge of all public recreation activities carried on by the city.

Sec. 2.17. - Department of public health; health officer.¶
There is hereby created a department of public health the duties of which shall be to enforce all laws, ordinances and regulations pertaining to public health. The health officer shall be appointed by the city council and be responsible to the city council.

Sec. 2.18. - Department of purchasing; purchasing agent.¶
There is hereby created a department of purchasing. The city administrator shall be the purchasing officer. The duties of the department of purchasing shall be to obtain supplies and equipment as needed by the city at as low prices as can reasonably be done.

Sec. 2.19. - Additional departments.¶
The city council may create and establish from time to time departments in addition to those established by this article.

Sec. 2.20. - Control of departments; hiring, discharge and compensation of employees.¶
The city administrator shall have general overall charge and control of all of the departments established by this article and the hiring and discharge of all employees necessary for the operation and functioning of the departments, excepting the statutory office of the city clerk, the statutory office of city treasurer, the department of law and the city auditor, but shall not have authority to increase the number of permanent employees of the city without express consent and approval of the city council. The compensation of all employees shall be fixed by the city council.

Sec. 2.21. - Absence, etc., of city administrator.¶
In the event of the absence of the city administrator or of the occurrence of a vacancy in the office of the city administrator, his duties shall fall on the city council who may delegate someone to perform his duties.
