Sec. 6.1. - License—Required.

Any bicycle, as defined in the Vehicle Code of the state of California, owned by a resident of the city and intended to be operated on any street, road, highway or other public property within the jurisdiction of the city, shall be licensed in accordance with Division 16.7 of the California Vehicle Code (Sections 39000 et seq.) prior to such operation.

Any bicycle owned by nonresident of the city may be licensed upon request of the owner.

Sec. 6.2. - Application and issuance of licenses.

The police department of the city is hereby authorized and directed, upon written application therefor, to issue bicycle licenses in accordance with Division 16.7 of the California Vehicle Code.

Sec. 6.3. - Fees.

The fee for a new bicycle license and registration certificate, transfer of ownership, replacement of a bicycle license or registration certificate or license renewal shall be the sum of one dollar.

Sec. 6.4. - Inspection of bicycles prior to licensing.

The chief of police, or an officer assigned such responsibility shall inspect each bicycle before licensing the same and shall refuse a license for any bicycle which he determines is in unsafe mechanical condition.

Sec. 6.5. - Monthly reports of bicycle dealers.

All persons engaged in the business of buying and/or selling new or used bicycles are required to keep a monthly report of purchases and sales of such bicycles. Such report is to be kept at the place of business and shall be available for inspection by any member of the Brawley police department investigating any lost or stolen bicycle. Such report shall include the following information:

(a) Name and address of each person from whom a bicycle is purchased or to whom a bicycle is sold;

(b) Brand name of bicycle;

(c) Description of frame, frame size, frame number or manufacturer's serial number, if any;

(d) The number of the license plate attached thereto, if any.

Each place of business required to keep the above records, shall display in the area in which bicycles are sold, a sign stating in bold print letters at least one inch in height that any resident of Brawley purchasing a bicycle to be operated in the city must obtain a bicycle license pursuant to Chapter 6 of this code.

Sec. 6.6. - Numbering of bicycle frames by police department.

Nothing in this chapter shall prohibit the police department from numbering or causing numbers to be placed on frames of bicycles on which no serial number can be found or on which the number is illegible or insufficient for identification purpose.

Sec. 6.7. - Carrying of passengers on bicycles.

(a) No person riding or operating a bicycle in the city shall carry another person on such bicycle, unless such person or passenger is seated upon an individual seat or carrier separated from that intended to be used by the operator. No person shall ride upon a bicycle as a passenger, unless he is seated upon an individual seat or carrier separate from that intended to be used by the operator.

(b) Only a bicycle having separate seat, handholds and footrest shall be considered equipped to carry any passenger other than the operator.

Sec. 6.8. - Riding upon sidewalks, parks, playgrounds, etc.

(a) No person shall ride a bicycle upon a sidewalk within the central business district.

(b) The city traffic engineer, with the approval of the city council, is authorized to erect or place signs in any district on any sidewalk or roadway prohibiting the riding of bicycles thereon by any person and when such signs are in place, no person shall disobey the same. Before such sign is erected or placed, it must be found that the riding of bicycles on such sidewalk or roadway will endanger pedestrian traffic or the public safety.

(c) Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.

(d) No person shall operate or ride a bicycle upon any playground, park or school ground, where children are playing, without permission of the person having supervision of such playground, park or school ground.

Sec. 6.9. - Parking bicycles upon streets or sidewalks.

No person shall park a bicycle upon a street other than upon the roadway against the curb or in a rack to support the bicycle or against a building or at the curb, in such a manner as to afford the least obstruction to pedestrian traffic. When a parking rack is provided, no person shall park a bicycle, except in such a rack, on an adjacent street or sidewalk within a distance of one hundred feet from such rack.

Sec. 6.10. - Stands required.

Every bicycle purchased after the effective date of this section 9 must be equipped with a stand and such stand must be of a type approved by the chief of police.

Sec. 6.11. - Applicability of chapter; violations by minors.

(a) The parent of or guardian of any child shall not authorize or knowingly permit any child or ward to violate any of the provisions of this chapter.

(b) These regulations applicable to bicycles shall apply whenever a bicycle is operated upon any street or sidewalk, or upon any public path set aside for the exclusive use of bicycles, subject to those exceptions stated therein.

(c) When this chapter is violated by persons under the age of eighteen years, in lieu of such fines and imprisonment as provided for misdemeanors, and in lieu of filing charges in juvenile court, the chief of police, or his duly appointed representative, may impound the bicycle so used in such violation for a period not to exceed thirty days, and require of the violator any of the following or any combination thereof:

(1) Be deprived of bicycle for a period not to exceed thirty days.

(2) Have parents of violator deprive violator of bicycle for a period not to exceed thirty days.

(3) Have a bicycle equipment inspected at the police department within five days of any equipment violation.

(4) Write a composition of not less than two hundred words on a subject title specified by the chief of police or his representative.

(5) Obtain a city bicycle license immediately.

(6) Copy the section of this chapter violated, one hundred times.
