Sec. 26.1. - Application for service—Prerequisites to furnishing service.

Before water is supplied to any premises or any consumer from the water system of the City, the owner or the occupant of the real property to which water is to be supplied must sign a written application therefor in such form as may be required by the City for such purpose, agreeing to pay for all water supplied at the rates established by the City and agreeing that water may be disconnected if the water bill is not paid when due; provided, however, that no water shall be furnished or supplied to any place of business or user whose premises are not served by a separate and direct connection to the water mains of the City.

Sec. 26.2. - Deposit for water service.

(a) Applications for water service for non-owner-occupied residential premises and owner and/or non-owner occupied commercial premises shall require a deposit to assure payment of water bills in an amount double the applicable monthly billing rate for water, trash, sewer service and utility user tax for a single residence and/or commercial establishment. Such deposit, less any amounts due to the City for unpaid water, trash and sewer service charges and utility sales tax shall be refunded upon the customer's request for discontinuance of service.

(b) Owners of premises shall be entitled to a refund of such deposit after one year, without interest, that such owner has timely paid all water service charges during such one-year period or during any immediately preceding one year period.

(c) Anything in this chapter to the contrary notwithstanding, the City Council may, by resolution, adopt such resolution as it deems appropriate to establish new or different terms from those set forth in this chapter.

Sec. 26.3. - Repealed by Ord. No. 2008-06.

Sec. 26.4. - Meter rates inside City.

For a metered connection with two or more units connected to one meter, the monthly rate shall be the sum of all the flat rates charged for each unit attached to the meter, as shown in section 26.3.

Sec. 26.5. - Service connection charges.

(a) Except for normal wear and tear in order to defray costs associated with connection to City water services, the City may establish connection fees by resolution.

(b) Any person who damages a water meter, valve or portion of the water distribution system, shall be liable for all costs associated with the repair.

Sec. 26.6. - Multiple users on one connection.

Where there is more than one unit served from one water connection to the City's water mains, the flat rate applicable to each such unit shall be charged to the owner having the direct water connection to the City's water mains.

Sec. 26.7. - Service and rates for users outside City.

(a) Any person desiring to be served water outside the City limits may make application to the City Council in writing therefor on forms to be supplied by the City, which may grant or deny such application, and in granting the same may impose any conditions the Council may require.

(b) No water shall be served outside the City except through a meter.

Sec. 26.8. - Payment of charges for City services.

Policy and procedure regarding payment of charges for City services shall be adopted by resolution of the City Council.

Sec. 26.9. - Tampering with service or unlawful connections.

It is unlawful and a misdemeanor for any person, other than an employee of the City, to turn on or off water service, or to make any connection to the water service or mains of the City or to bypass any connection thereby obtaining water free, or to alter, change or interfere with any water meter installed by the City.

Sec. 26.10. - Vacancies in multiple units.

No allowance or credit shall be given for vacancies in multiple dwelling or other units unless the unit claimed to be vacant is separately connected to the City water mains so it can be shut off and has been shut or turned off at the request of the owner or user.

Sec. 26.11. - Installation of meters.

Beginning May 20, 2000 installation of water meters will be required for all new residential, commercial, and industrial connections. The charge for the connection shall be established by Section 26.5 of the Brawley Municipal Code and shall be paid at the time of application for connection to the City water system. The director of public works may, in his sole discretion, authorize persons other than the City to perform the installation. As a condition to authorizing persons other than the City to perform the installation, the Director of Public Works may require good and sufficient security to be deposited to guarantee that the work is done in accordance with City meter installation standards, including, but not limited to, a City approved water meter.

Sec. 26.12. - Rates not otherwise provided for.

The City Council may by resolution set any rate not provided for in this chapter.

Sec. 26.13. - Temporary water use.

Applications for temporary water use shall be made in writing on forms provided by the Director of Public Works. All temporary water connections shall be made through fire hydrants or such other source as approved by the Director of Public Works. All such water used shall be metered. The rate for such service shall be eighty-three cents per one thousand gallons of water used, plus a minimum fee of ten dollars per day. A deposit of two hundred dollars shall be required with the application for a temporary water use connection. The deposit less the charge for water used and ten dollars per day fee will be refunded upon return of the meter and turn-on valve equipment. If the charges exceed the deposit, a bill will be sent for the difference. In the event the meter furnished by the City for such temporary use is damaged or malfunctions and such fact is not reported to the Director of Public Works prior to any subsequent use, a flat fee of fifty dollars per day will be charged for such water.

Sec. 26.14. - Fees for voluntary disconnection and reconnection of water service.

The fees for the disconnection and reconnection of water service at the request of a user shall be as follows:

  1. The sum of twenty dollars for such service performed during regular working hours;

  2. The sum of thirty dollars for such service performed between the hours of five p.m. to eight a.m., or on holidays or weekends.

Sec. 26.15. - Return check fee.

If any payment for water by check is returned by the bank, a thirty dollar return check fee will be assessed.

Sec. 26.16. - Discount for automatic debit payment, prepayment or payment at an…

(a) Any customer who authorizes an automatic debit to their checking or savings account for payment of their water, sewer and trash bill will receive a one dollar per unit discount off their monthly water rate.
