Brawley Municipal Code Ch. 19B Parking and Business Improvement Area

Sec. 19B.1. - Established.¶
A parking and business improvement area is established within the city, pursuant to the Parking and Business Improvement Area Law of 1965 and pursuant to Resolution No. 3167.

Sec. 19B.2. - Boundaries.¶
The description of the boundaries of the parking and business improvement area hereby established are as follows:
Beginning at a point, said point being the intersection of the centerline of E Street with the centerline of North 8th Street; thence southerly along the centerline of North 8th Street and continuing along the centerline of South 8th Street to the intersection of said line with the centerline of G Street; thence westerly along the centerline of G Street to its intersection with the centerline of South 5th Street; thence northwesterly along the centerline of South 5th Street to its intersection with the centerline of South Plaza Street; thence northeasterly along the centerline of South Plaza Street to its intersection with the centerline of Main Street; thence along the centerline of North Plaza Street in a northwesterly direction to its intersection with the centerline of North 5th Street; thence northeasterly along the centerline of North 5th Street to its intersection with the centerline of E Street; thence easterly along the centerline of E Street to its intersection with the centerline of North 8th Street, said point being the point of beginning.
Beginning at the centerline intersections of "E" Street and North Ninth Street, thence east 581.62 feet to the centerline intersections of "E" Street and North Tenth Street; thence south 820.0 feet to the centerline intersections of South Tenth Street and "G" Street; thence west 810.15 feet to the centerline intersections of "G" Street and South Ninth Street; thence north 15° 34' 22" east 851.25 feet to the point of beginning.

Sec. 19B.3. - Definitions.¶
The terms "general business tax," "business license tax," and "basic business license tax," as used in this chapter are defined and intended to mean the business license taxes imposed upon particular businesses, occupations, trades or professions within the city as set forth in chapter 16 of this Code, as the same presently provides or may hereafter be amended.

Sec. 19B.4. - Additional business license tax imposed.¶
In addition to the general business license tax imposed on businesses within the city, there shall be imposed upon businesses located within the parking and business improvement area as established by this chapter, or within the boundaries of the parking and business improvement area as the same may hereafter be amended, an additional business license tax in an amount equal to one-fourth of the basic business license tax, which shall be levied, collected and enforced in the same manner, at the same time and with the same penalties and interest as the general business license tax.

Sec. 19B.5. - Use of funds.¶
The taxes raised by the levy of the additional business license tax as established hereunder shall be used solely for any or all of the following purposes:
The acquisition, construction or maintenance of parking facilities for the benefit of the area;
Decoration of any public place in the area;
Promotion of public events which are to take place on or in public places in the area;
Furnishing of music in any public place in the area;
The general promotion of retail trade activities in the area.

Sec. 19B.6. - Further additional tax levy.¶
Commencing September 1, 1975, a further additional levy shall be made upon each business within the parking and business improvement area in the amount of fifty percent of the general license tax imposed upon each such respective business as set forth in chapter 16 of this Code, as the same now provides or may be hereafter amended. The additional taxes levied and collected under this section shall be turned over to the Brawley Chamber of Commerce to be used exclusively for the general promotion of retail trade activities in the parking and business improvement area.
