3.70.010 - Surplus materials and equipment.¶
A. The purchasing agent shall have authority to exchange for, or trade in on new materials and equipment all materials and equipment which cannot be used by any agency or which have become unsuitable for city use. Materials, equipment and other personal property with an estimated value of five thousand dollars or less may be sold as surplus without prior city council approval and without formal bids. All surplus materials, equipment and other personal property with an estimated value greater than five thousand dollars shall be subject to the same formal bidding procedure and approval of sale as provided for in Sections 3.20.120 through 3.20.200, or the sale of such property may be negotiated by the purchasing agent subject to final approval by the city council.
B. All surplus or worn out materials, equipment or other personal property may be transferred, donated or dedicated to, or may be permitted to be used by, community service or public benefit organizations, which, in the opinion of the purchasing agent or his authorized representative, would use such materials, equipment or other personal property exclusively to promote the general municipal welfare or otherwise use the surplus materials, equipment or other personal property for purposes of which the public benefit is clear.

3.70.020 - Real property.¶
Sale of real property owned by the city may be by written contract with the highest and best responsible bidder pursuant to the procedure prescribed in Sections 3.70.030 through 3.70.100 or may be negotiated by the city manager, subject to final approval by the city council.

3.70.030 - Advertising for proposals—Notice inviting bids.¶
Advertising for sealed bids or proposals shall be publicly noticed, either in the local newspaper or the city's website at least ten days prior to the time for opening of bids. The time and place of the sale shall be included in the notice. The property proposed to be sold must be described with particularity, and shall also be described by its street address, if any, or other common designation, if any; but, if a legal description of the property is given, the validity of the notice shall not to affected by the fact that the street address or other common designation recited is erroneous, or that the street address or other common designation is omitted. The notice inviting bids may contain such conditions, provisions or terms as are necessary or convenient for the sale of the property. The council may authorize oral bids to be made at public meeting where the sale is approved.

3.70.040 - Bids—Forms—Checks.¶
All bids or offers shall be in writing and shall be accompanied by a bank cashier's check or by a check certified by a responsible bank, payable to the city, in an amount as specified in the notice inviting bids.

3.70.050 - Submission and opening of bids.¶
Sealed bids shall be submitted to the office of the city clerk and shall be identified as bids regarding the property to be sold on the envelope. The city clerk shall direct opening of bids in public at the time and place stated in the public notice. As each bid is opened, it shall be read aloud so that all persons interested in the bidding may become acquainted with the contents thereof.

3.70.060 - Analysis and report of bids.¶
After they have been opened, all bids shall be referred to the city manager for analysis and report to the city council, together with such recommendations as he may deem appropriate.

3.70.070 - Approval of sale.¶
A. Sale of the property shall be by approval of the sale by the city council at a public meeting, the time and place of which shall be indicated to each bidder.
B. The city council may approve the sale to any bidder, or may reject all bids and direct another call for bids, or may withdraw the property from sale. The city council shall approve the highest and best responsible bid if it decides to consummate the sale. In case of bids in the identical amount, the city council may determine by lot which bid shall be accepted.
C. The cashier's check of the successful bidder may be applied to the purchase price. If the successful bidder without good, sufficient and legal cause fails to complete the purchase, the certified check or bank cashier's check and the amount therein mentioned shall be forfeited to the city and shall collected and paid into the general fund.
D. If the successful bidder fails to complete the purchase, the city council may approve the sale to the next highest bidder, call for new bids, or withdraw the property from sale.

3.70.080 - Transaction with public agencies.¶
Where real property is to be sold, leased or transferred to the state, or federal government, or any other public agency, the notice and bidding requirements set out in Sections 3.70.030 through 3.70.100 may be dispensed with, and the transfer made on the basis of negotiation.

3.70.090 - Lease transactions.¶
Property to be leased from the city may be negotiated by the city manager, subject to final approval by the city council, or may be leased by using the notice and bidding requirements contained in Sections 3.70.030 through 3.70.100.

3.70.100 - Negotiation of parcel exchanges and sale of remnant parcels.¶
When real property owned by the city is to be exchanged or traded for real property owned by other parties, such transaction may be negotiated by the city manager, subject to final approval by the city council. When small remnant parcels which have little value on the open market are to be sold, the city council may authorize by resolution the city manager to negotiate the sale, subject to final approval by the city council.

3.70.110 - Real property asset management policy.¶
The city manager or his or her authorized representative shall prepare and recommend to the city council rules and regulations governing the management, leasing and sale of the city's real property. Said rules and regulations shall be adopted by resolution of the city council.
