3.52.010 - Creation.

Pursuant to Section 711 of the Charter of the city, there is created a "curb, gutter and sidewalk revolving fund" in an initial principal amount to be fixed by resolution adopted by the city council. The principal amount of the fund may be increased or decreased upon the adoption of an appropriate resolution by the city council.

3.52.020 - Purpose.

The purpose of the revolving fund is to further the street improvement proms provided for in Chapter 10.02 of this code by advancing money needed to construct curbs, gutters and sidewalks subject to property owner's obligation to reimburse the fund by the payment of assessments for such improvements in monthly, semiannual or annual installments, and by funding the public's s of the cost of such curb, gutter and sidewalk, including the repair as necessary of any defective or hazardous side not resulting from intentional abuse or gross carelessness of the owner, tenant or other lawful occupant of the abutting property, within the city limits, commencing July 1, 1975.

3.52.030 - Advances.

Advances from the revolving fund shall be made by the city upon the execution and delivery of appropriate legal documents in form and substance approved by the public works director/city engineer and the city attorney, and signed by the property owner or his/her authorized representative, and by the city manager on behalf of the city. Interest on the principal amount of the property owner's obligation for the assessment shall be charged at a rate to be determined by the city council, and no such repayment agreement shall be for a period greater than five years, and in no case shall the installment payments, including interest, be less than ten dollars per month, or sixty dollars semiannually, or one hundred twenty dollars per year.

3.52.040 - Additional Uses.

The revolving fund shall also be used for the funding of the public's share of the cost of curbs, gutters and sidewalks under the street improvement program set out in Chapter 10.02 of this code. The public's share of the cost of the proms shall be limited to paying for:

A. The cost of curb, gutter and sidewalk at all curb returns at public street intentions;

B. The cost of corner lot reductions as defined in subsection D of Section 10.02.020 of this code;

C. The cost of curb, gutter and sidewalk across, along and through railroad rights-of-way located in the city;

D. The cost of unusual requirements, such as residential property with double frontages where one frontage has no usable or direct access to the public street;

E. The cost to the city in sharing with the Vallejo sanitation and flood control district, or other public agency, in the cost of minor drainage improvements, such as catch basins and laterals;

F. The cost of curb, gutter and sidewalk which is the obligation of the city to construct by virtue of its property ownership;

G. The cost of engineering required to accomplish the installation of curb, gutter and sidewalk;

H. The cost of repairs as necessary of any defective or hazardous sidewalks not resulting from intentional abuse or gross carelessness of the owner, tenant or other lawful occupant of the abutting property, within the city limits, commencing July 1, 1975.
