OUTDOOR DISPLAY AND SALES

17.76.010 Purpose. The purpose of this Chapter is to establish standards for the location, site planning, development, and operations of certain land uses that are allowed by Article 2, Zoning Districts and Allowable Land Uses, within individual or multiple districts, and for activities that require special standards to minimize the impacts of these uses and activities on surrounding properties and to protect the health, safety, and welfare of their occupants and of the general public.

17.76.020 Applicability. The requirements contained in this Chapter shall apply to all outdoor display and sales uses.

17.76.030 Permit Required. All outdoor display and sales uses shall be subject to approval of the specified permit as detailed in the use tables in Article 2.

17.76.040 Development and Operational Standards.

A. Outdoor display and sales shall be located, developed, and operated in compliance with the following standards:

  1. Temporary Outdoor Display and Sales. The temporary outdoor display and sale of merchandise shall comply with Chapter 17.92, Temporary Uses, and Section 17.100.060, Temporary Use Permits.

  2. Produce and Nursery Displays. The outdoor display of fresh produce or of live plants associated with an

existing retail sales establishment on the same site is allowed, and no additional parking is required, subject to the following standards.

  • a. The display area shall not exceed 125 square feet for produce displays or 600 square feet for live plant displays unless a larger area is authorized pursuant to Use Permit approval.

  • b. The display shall not disrupt the normal function of the site nor its circulation and shall not encroach upon parking spaces, driveways, pedestrian walkways, or required landscaped areas.

  • c. All produce shall be removed or enclosed at the close of each business day.

  1. Permanent or Ongoing Outdoor Display and Sales. The permanent or ongoing outdoor display of merchandise, except for vehicle sales and leasing, requires Use Permit approval and shall comply with the following standards:
  • a. Relationship to Main Use. The outdoor

display and sales area shall be directly related to a business occupying a primary structure on the subject parcel. b. Allowable Merchandise. Only merchandise sold at the business is permitted to be displayed outdoors. c. Display Locations. The displayed merchandise shall occupy a fixed, specifically approved and defined location and shall not disrupt the normal function of the site nor its circulation and shall not encroach upon parking spaces, driveways, pedestrian walkways, or required landscaped areas.
