EMERGENCY SHELTERS

17.58.010 Purpose. The purpose of this Chapter is to establish standards for the location, site planning, development, and operations of certain land uses that are allowed by Article 2, Zoning Districts and Allowable Land Uses, within individual or multiple districts, and for activities that require special standards to minimize the impacts of these uses and activities on surrounding properties and to protect the health, safety, and welfare of their occupants and of the general public. All regulations contained in this Chapter are intended comply with the requirements of state law under California Government Code Section 65583 and may be updated from time to time as needed to reflect changes to the Government Code.

17.58.020 Applicability. Emergency shelters are a permitted use in the R-2 (Medium Density Residential), R-3 (Multiple Family Residential), C-O (Special Commercial), C-1 (General Commercial) and M-U (Mixed Use) zoning districts, subject to the same restrictions that apply to other residential uses within these zones. Emergency shelters shall not be required to be more than 300 feet from any other emergency shelter.

17.58.030 Permit Required. In zoning districts where emergency shelters are allowed, the only permit required is a building permit.

17.58.040 Development and Operational

Standards. Emergency shelters shall comply with all standards set forth in this Chapter in addition to any development standards in the

underlying zoning district. In the event of conflict between these standards and the underlying zoning district regulations, the provisions of this Chapter shall apply.

  • A. Physical Characteristics.
  1. All emergency shelters shall comply with applicable state and local uniform housing and building code requirements.

  2. The facility shall have on-site security during all hours when the shelter is in operation.

  3. Facilities shall provide exterior lighting on pedestrian pathways and parking lot areas on the property. Lighting shall reflect away from residential areas and public streets.

  4. Facilities shall provide secure areas for personal property.

  • B. Limited Number of Beds per Facility.

  • Emergency shelters shall not exceed 25 beds.

C. Floor Area. An emergency shelter must contain a minimum of 200 square feet of gross floor area per bed.

D. Limited Terms of Stay. The maximum term of staying at an emergency shelter is 6 months.

E. Parking. Off-street parking at an emergency shelter must be provided at the ratio of one for each employee per largest shift.

F. Emergency Shelter Management. Emergency shelters shall provide on-site management (Ord. 3471 § 13, 2024).
