INDOOR RETAIL SALES AND SERVICES

17.66.010 Purpose. 17.66.020 Applicability. 17.66.030 Permit Required.

17.66.010 Purpose . The purpose of this Chapter is to establish standards for the location, site planning, development, and operations of certain land uses that are allowed by Article 2, Zoning Districts and Allowable Land Uses, within individual or multiple districts, and for activities that require special standards to minimize the impacts of these uses and activities on surrounding properties and to protect the health, safety, and welfare of their occupants and of the general public. The regulations set forth in this Chapter shall modify or supplement the zoning district regulations appearing elsewhere in this title relating to indoor retail sales and services.

the community in which it is proposed, blend with the surrounding neighborhood, or be consistent with any applicable design standards in the General Plan or as provided in this title.

B. The retail sales or retail services establishment or shopping center shall be designed and located to be compatible with, rather than imposed on, the landscape and environment by minimizing the amount of grading and topographical alteration and shall be designed in accordance with the provisions of the Tuolumne County Hillside and Hilltop Development Guidelines.

17.66.020 Applicability. The requirements contained in this Chapter shall apply to all indoor retail sales and services uses that require a use permit from the County.

17.66.030 Permit Required. Where retail sales, indoor, retail services, indoor, or shopping centers are subject to the requirements established herein, the application for a conditional use permit or application for a site development permit shall be referred to the Director or Planning Commission. Any approved conditional use permit or site development permit shall include conditions to ensure compliance with the following provisions:

17.68.010 Purpose . The purpose of this Chapter is to establish standards for the location, site planning, development, and operations of certain land uses that are allowed by Article 2, Zoning Districts and Allowable Land Uses, within individual or multiple districts, and for activities that require special standards to minimize the impacts of these uses and activities on surrounding properties and to protect the health, safety, and welfare of their occupants and of the general public. The regulations set forth in this Chapter shall modify or supplement the zoning district regulations appearing elsewhere in this title relating to mobile food vendors.

17.68.020 Applicability. Mobile food vendor uses shall be allowed as shown in the use tables in Article 2.

pedestrian traffic. The location shall comply with applicable accessibility requirements and the Americans with Disabilities Act.

C. A mobile food vendor shall not remain on the same parcel for more than six hours per day, exclusive of set up and take down time, except as provided in subdivision E, or unless a conditional use permit has been obtained. Vehicles/mobile food facility must be removed to the commissary location or other location as approved by Environmental Health.

D. A mobile food vendor shall not park within a County road right-of-way.

E. Notwithstanding subdivision C, mobile food vendors at a flea market, fair, circus, outdoor music festival or similar event may remain on the parcel for the duration of the event and shall be removed from the parcel when the event ceases (Ord. 3471 § 14, 2024)

17.68.030 Permit Required. Mobile food vendors shall be allowed following any approval needed from Environmental Health.

17.68.040 Development and Operational Standards.

A. A mobile food vendor shall comply with the California Retail Food Code (Part 7 (commencing with Section 113700) of Division 104 of the California Health and Safety Code).

B. Location and operation including customers, seating, and equipment, shall not obstruct the right-of-way, sight distances, or otherwise create hazards for vehicle or
