ENTERTAINMENT AND ALCOHOLIC BEVERAGE SERVICE

17.60.010 Purpose . The purpose of this Chapter is to establish standards for the location, site planning, development, and operations of certain land uses that are allowed by Article 2, Zoning Districts and Allowable Land Uses, within individual or multiple districts, and for activities that require special standards to minimize the impacts of these uses and activities on surrounding properties and to protect the health, safety, and welfare of their occupants and of the general public. The regulations set forth in this Chapter shall modify or supplement the zoning district regulations appearing elsewhere in this title relating to entertainment and alcoholic beverage service.

17.60.020 Applicability. The

requirements contained in this Chapter shall apply to all entertainment and alcoholic beverage service uses.

17.60.030 Permit Required. All

entertainment and alcoholic beverage service uses shall be subject to approval of the specified permit as detailed in the use tables in Article 2.

17.60.040 Development and Operational Standards.

A. Service of beer and wine when incidental to food service in a restaurant in a Commercial (C), Recreational (K), Mixed Use (MU), or Business Park (BP) Zoning District is permitted and may be allowed after the hour of 9:00 p.m. if the following requirements can be met:

A sign plan shall be submitted to the Tuolumne County Community Development Department prior to issuance of a Building Permit for any proposed signs on the project site. All signs proposed shall adhere to Chapter 17.34 of the Tuolumne County Ordinance Code. Building Permits shall be secured from the Building and Safety Division of the Community Development Department prior to the placement of on-site signage. A lighting plan shall be submitted to the Community Development Department prior to the installation of any exterior lighting. The lighting plan shall incorporate the following: direct the light downward to the area to be illuminated, install shields to direct light and reduce glare, utilize low rise light standards or fixtures attached to the buildings, and utilize low or high pressure sodium lamps instead of halogen type lights. The lighting plan shall comply with the International Dark Sky Association standards and fixtures shall have the International Dark Sky Fixture seal of approval.

  1. Service of beer and wine shall only be permitted and must be served in conjunction with food. No hard alcohol or liquor shall be served on site. No amplification of music or other sounds shall be utilized on site. Outdoor nonamplified music is permitted during business hours only.
  • B. Entertainment with amplified music

  • provided at businesses in a Commercial (C), Recreational (K), Mixed Use (MU), or Business Park (BP) Zoning District is permitted and may be allowed as a conditional use after the hour of 9:00 p.m.

  • C. The following regulations shall apply

  • to all alcohol-related uses.

    1. Prohibited Activities. The property owner and/or individual responsible for said property shall take all steps necessary to ensure that individuals shall not loiter upon the property before and after regularly established business hours.
  • D. The following regulations shall apply

  • to alcohol sales.

E. The following regulations shall apply to establishments with on-site alcohol consumption.

  1. For uses with 50 percent or more of floor area designated as bar space, excluding kitchens, storage spaces, and restrooms, hours of operation for the identified use shall be no earlier than 11:00 a.m. and no later than 2:00 a.m. the following day. Outdoor activities must cease by 12:00 a.m. the next day.

  2. For uses with less than 50 percent of floor area designated as bar space, excluding kitchens, storage spaces, and restrooms, hours of operation for the identified use shall be no earlier than 6:00 a.m. and not later than 2:00 a.m. the following day. Outdoor activities must cease by 12:00 a.m. the next day.

    1. This limitation shall not apply where the primary use of the business is a full service restaurant as defined in this Development Code.
  3. Hours of operation for the identified use shall be no earlier than 6:00 a.m. and no later than midnight the same day.
