2.65.010 - Establishment.

A. There is established the Shasta County children and families commission, which may also be known as the First 5 Shasta Commission. Said commission shall be deemed a legal public entity separate from the county.

B. There is established within the county treasury a trust fund to receive funds distributed from the California children and families trust fund. Funds deposited into the county trust fund shall only be expended for purposes authorized by the California Children and Families Act. This local trust fund shall be administered by the Shasta County auditor/controller and shall be known as the Shasta County children and families trust fund.

2.65.020 - Definitions and references to law.

For the purposes of this chapter, the following definitions apply:

"Board of supervisors" means the Shasta County board of supervisors.

"California Children and Families Act" or "act" means the laws and amendments to the California Constitution and statutes of the state of California enacted as the California Children and Families First Initiative, Proposition 10, at the general election of November 3, 1998, and any subsequent amendments thereto.

"Code" means the Shasta County Code.

"Commission" means the Shasta County children and families commission.

"Commissioner" means an incumbent member of the Shasta County children and families commission.

"County" means Shasta County.

"County health officer" means the Shasta County health officer.

"State commission" means the California children and families commission.

2.65.030 - Membership—Term and removal.

A. The commission shall be composed of nine members appointed by the board of supervisors as follows:

  1. Seat 1—One member shall be a member of the board of supervisors who shall be the member serving as the health and welfare liaison, or such other member as the board of supervisors may select.

  2. Seat 2—One member shall be the county health officer or his/her designee as approved by the board of supervisors.

  3. Seat 3—One member shall be the director of the county health and human services agency or his/her designee as approved by the board of supervisors.

  4. Seats 4, 5, 6, 7, 8, and 9—Six members shall be persons selected by the board of supervisors from among the following categories:

a. Representatives of community-based organizations that have the goal of promoting nurturing and early childhood development;

b. Educators specializing in early childhood development;

c. Representatives of a local child care resource or referral agency, or a local child care coordinating group;

d. Representatives of a local organization for prevention or early intervention for families at risk;

e. Representatives of local medical, pediatric, or obstetric associations or societies;

f. Representatives of local school districts; and

g. Recipients of project services included in the county strategic plan.

B. Each commissioner's term shall commence at twelve o'clock noon on the date of the first meeting of the board of supervisors after the January 1 st succeeding his/her appointment or such other time as may be determined by the board of supervisors. For all appointments to the commission with terms commencing on or after January 1, 2014, each commissioner shall serve a term of three years. Initial appointments commencing on or after January 1, 2014 shall be staggered at one, two and three year terms as follows:

  1. Seats 1, 2, and 3—Initial term shall be for one year.

  2. Seats 4, 5, and 8—Initial term shall be for two years.

  3. Seats 6, 7, and 9—Initial term shall be for three years.

Initial appointments for seats 8 and 9 shall have terms commencing on or after January 1, 2020.

For all subsequent appointments, the term of each commissioner shall be three years. Except in cases of removal from office, a commissioner shall serve until the appointment of a successor. Except in cases of removal from office, a commissioner may be reappointed to successive terms.

C. A commissioner serves at the pleasure of the board of supervisors and may be removed from office by the board of supervisors at any time. A vacancy shall be filled for the remainder of the unexpired term in the same manner as original appointments are made. The commission may make recommendations of candidates for appointment by the board of supervisors either to fill a vacancy or to commence a new term. The board of supervisors is under no obligation to accept any such commission recommendation. In the event of a vacancy, the board of supervisors shall act within sixty days to fill the vacancy.

D. The provisions of Sections 2.65.030(B) that were in effect prior to the effective date of Ordinance No. SCC 2013-02 shall apply to commissioner appointments with terms commencing before January 1, 2014, and shall be superseded by Ordinance No. SCC 2013-02 upon the conclusion of said appointments.

2.65.040 - Duties, administration, and compensation.

A. The commission shall implement the goals and objectives of the act. The commission shall exercise all powers, duties, and functions as are prescribed by the act, the board of supervisors and the state commission.

B. The county shall be compensated from the Shasta County children and families trust fund on an actual cost basis for the direct and indirect costs of support attributable to the operation of the commission and advisory committees established pursuant to Section 2.65.070.

C. Subject to the provisions of this code and the act, the commission shall adopt procedural rules for the conduct of meetings, hearings, and other business before it; provided that four commissioners shall constitute a quorum and the affirmative vote of four commissioners is required to approve or make a recommendation for approval as appropriate, upon the merits of any matter before the commission.

D. The commission's meetings shall be subject to the open meeting laws of the Ralph M. Brown Act.

E. The commission shall comply with the provisions of the Political Reform Act of 1974.

F. A reasonable number of copies of the commission's annual audits and reports and its strategic plans shall be available to the general public on request and at no cost.

G. The commission shall elect a chair and vice-chair from among its members and may remove such officers at any time, provided that neither shall serve beyond a term of one year from his/her election, unless first re-elected.

H. The clerk of the board of supervisors shall certify to the board of supervisors when a vacancy occurs on the commission and will obtain an annual statement of economic interest from each commissioner and the commission's executive director.

I. Commissioners shall serve without compensation. However, each commissioner shall be reimbursed for reasonable expenses, as authorized by the commission, for attending meetings and discharging other official responsibilities at the same rates and in the same manner and subject to the same limitations applicable to county officers and employees. In no event shall any reimbursement be received unless a claim in the form prescribed by the county has been submitted. Payments pursuant to this section are subject to and limited by the availability of funds appropriated specifically for direct support of the commission in its budget.

2.65.050 - Adoption of county strategic plan.

A. The commission shall adopt an adequate and complete county strategic plan pursuant to the act.

B. Prior to first adopting the county strategic plan, the commission shall conduct at least one public hearing on the proposed plan.

C. The commission shall, on at least an annual basis, review the county strategic plan and revise it as may be necessary or appropriate. Prior to adopting any revisions to the plan, the commission shall conduct at least one public hearing.

D. The commission shall submit its adopted county strategic plan, and any subsequent revisions thereto, to the state commission and the board of supervisors.

2.65.060 - Annual audits and reports.

A. On or before October 15 of each year, the commission shall prepare and adopt an annual audit and report. Prior to adopting the annual audit and report, the commission shall conduct at least one public hearing.

B. The commission shall transmit a copy of the annual audit and report to the state commission and to the board of supervisors.

C. Pursuant to the act, the state commission is required, on or before January 31 of each year, to prepare a written report that consolidates, summarizes, analyzes, and comments on the annual audits and reports submitted by all the county commissions for the preceding fiscal year. The act further provides that this annual report must be submitted to each county commission. The commission shall conduct at least one public hearing on each annual report submitted to it by the state commission within sixty days of the receipt of said report.

2.65.070 - Advisory committees.

The commission may establish one or more advisory committees as deemed appropriate to provide technical and professional expertise and support for any purposes that will be beneficial in accomplishing the purposes of the act. The commission shall provide for the number, manner of appointment, selection, or removal of members of the advisory committees; the duration and number of terms advisory members shall serve; and any other matters that the commission deems necessary or convenient for the conduct of the activities of the advisory committees.
