2.48.010 - Organization—Function.

A. There is in Shasta County the county planning agency, composed of the board of supervisors as its legislative body, the planning commission, and the planning division.

B. The board of supervisors shall oversee the work of the planning agency and shall perform all duties and functions of a planning agency under the State Planning and Zoning Law, except as otherwise provided by this code or direction of the board of supervisors.

C. All county departments are adjuncts of the planning agency and shall promptly furnish such available information as the board of supervisors may request for the agency's work.

2.48.020 - Planning commission—Duties.

A. The planning commission shall review and act upon all proposals to amend the general plan or to adopt or amend specific plans and shall administer the general plan, pursuant to Articles 6, 7 and 8 of Chapter 3 of the State Planning and Zoning Law (Government Code Section 65000 et seq.)

B. The commission is a board of zoning adjustment pursuant to Article 3 of Chapter 4 of the State Planning and Zoning Law and shall hear and decide all applications for use permits and zoning variances pursuant to Title 17 (Zoning) of this code.

C. The commission is the advisory agency pursuant to the Subdivision Map Act for tentative maps and has authority to approve, conditionally approve or disapprove such maps pursuant to Title 15 (Subdivisions) of this code.

D. The commission shall hear and make a written recommendation to the board of supervisors on any proposal to amend the zoning plan pursuant to Title 17 of this code.

E. The commission is designated as an airport zoning commission pursuant to Government Code Section 50485.6.

F. The commission shall hear and decide or make its recommendation upon, as appropriate, such other matters as may be referred to it by the board of supervisors.

2.48.030 - Planning commission—Membership—Appointment.

The commission is composed of five members, each of whom shall be a resident of Shasta County. Each member of the board of supervisors shall nominate for appointment or propose for reappointment to the commission one member of the public, who shall be a resident of the district represented by that supervisor. The nomination of a new commissioner shall be made at a meeting held not less than six days prior to the meeting at which the commissioner is appointed to the commission. When a supervisor is proposing the reappointment of a sitting member of the commission, a nomination is not required. Instead, the supervisor may propose the incumbent commissioner for reappointment and the board may reappoint the commissioner at a single meeting.

2.48.040 - Planning commission—Terms—Removal.

A. Each commissioner shall serve a term of four years, which shall be concurrent with the term of the member of the board of supervisors for the district in which the commissioner resides. Each commissioner's term shall commence at twelve o'clock noon on the second Monday after January 1 of the year in which the supervisor for the affected district takes office. The terms of office for commissioners holding office as of the effective date of the ordinance codified in this chapter are adjusted, as necessary, to coincide with the incumbent supervisors' respective terms of office. Except in cases of removal from office and notwithstanding the above, a commissioner shall serve until the appointment of a successor.

B. A commissioner serves at the pleasure of the board of supervisors and may be removed from office by the board at any time. A vacancy by other than expiration of the term shall be filled for the remainder of the unexpired term in the same manner as original appointments are made.

2.48.050 - Planning commission— Conflicting appointments.

No commissioner shall be an officer or employee of Shasta County, except in the capacity of planning commissioner. No commissioner shall hold any other public office if the duties and responsibilities of that office may by incompatible with the duties and responsibilities of a planning commissioner.

2.48.060 - Planning commission—Alternate members.

For each commissioner there may be an alternate commissioner possessing the same qualifications as a commissioner and nominated, appointed and removed from office in the same manner as a commissioner. The alternate will sit in the absence of the commissioner and except in the case of removal from office will serve the same term as the commissioner.

2.48.070 - Planning commission—Administration.

A. The commission shall elect a chairman and vice-chairman from among its members and may remove such officers at any time; provided, that neither shall serve beyond a term of one year from his election unless first reelected. The commission shall meet regularly and at least once monthly.

B. The commission shall adopt procedural rules for the conduct of hearings and other business before it; provided, that three commissioners shall constitute a quorum and the affirmative vote of three commissioners is required to approve or make a recommendation for approval as appropriate, upon the merits of any matter before the commission.

2.48.080 - Planning commission—Compensation.

A. For services rendered as a commissioner, each commissioner shall be compensated as follows:

  1. For attending a meeting of the commission, seventy-five dollars;

  2. For attending a field trip called by the commission, twenty-five dollars.

No commissioner shall receive more than one hundred dollars in compensation pursuant to this subsection for all services rendered during any day.

B. For costs incurred in serving as a commissioner, each commissioner shall be reimbursed as follows:

  1. For the cost of meals when attending a commission meeting or field trip both before and after breakfast, lunch or dinner during any day;

  2. For each mile necessarily traveled in the commissioner's private vehicle to attend a commission meeting or field trip, a mileage allowance equal to that provided county officers and employees. However, no reimbursement shall be paid to a commissioner for miles driven to the site of a field trip unless a county-owned vehicle is not available for use by the commission, or for miles driven to the point of departure of the commission for a field trip in excess of the mile that would be driven by the commissioner in driving directly to the project site;

  3. For the reasonable cost of overnight lodging required to attend a commission meeting or field trip;

  4. For any necessary and reasonable expenses incurred in attending a land use conference or program, when such attendance has been previously approved by the commission.

Reimbursement under this section for meals, mileage, lodging or expenses shall be made at the same rates and in the same manner and shall be subject to the same limitations applicable to county officers and employees, as set forth in the county personnel manual.

C. The payment of compensation and the reimbursement for expenses authorized by this section are subject to and limited by the availability of funds appropriated specifically for direct support of the commission in the budget of the community development department.
