17.08.010 Building board of appeals—Powers.

The building board of appeals shall hear and decide appeals of orders, decisions or determinations made by the

building o\cial relative to the application and interpretations of the Uniform Building Code, the National Electrical

Code, the Uniform Plumbing Code, the Uniform Mechanical Code, and Uniform Housing Code, as presently

adopted by the city and as such codes may be amended.

All such determinations shall be for purposes of clariZcation and shall be of uniform application throughout the

city and shall not operate to create an exception from any ordinance or state law. (Ord. 1976 NCS §5, 1995; Ord.

17.08.020 Right of appeal.

Any person may appeal from any notice or any action of the building o\cial as cited in Section 17.08.010. (Ord.

17.08.030 Appeal procedure.

Every appeal shall be in writing on forms approved by the board and furnished by the building inspector.

Every such appeal shall be Zled with the building o\cial at least ten days prior to being considered by the board.

Every such appeal shall indicate the code provision or provisions concerned, the nature of the appeal, the type of

material or construction intended to be used and shall be accompanied by such drawings, plans, information or

17.08.040 Appeal—Additional comments and recommendations in writing

or orally.

The appellant or any other interested person may submit, in writing, his comments and recommendations

concerning the subject matter of the appeal.

The board may, at its discretion, permit the appellant or any other interested person to appear and make oral

comments and recommendations on the subject matter of the appeal. (Ord. 651 NCS § 1; prior code §2.84.)

17.08.050 Determinations.

All determinations shall be transmitted in writing to the building o\cial and to the person appealing. The building

o\cial shall permanently maintain a copy of each determination for public inspection.

17.08.060 Advisory action.

The board of building review may recommend amendments for any of the above cited codes to the city council.

Such recommendation shall be in the form of a report and draft ordinance and shall be adopted by motion. Upon

adoption, the recommendation shall be transmitted to the city clerk for presentation to the council. (Ord. 651 NCS

17.08.070 Limitations of powers.

The board of appeals or the housing advisory and appeals board shall not be empowered to waive requirements

of these codes cited in Section 17.08.010.

The Uniform Building Code "Board of Appeals" established by Ordinance No. 651/52 N.C.S. shall hereafter also be

known as the "housing advisory and appeals board", this board being required by the Uniform Housing Code.
