Chapter 2.16 — PARKS AND RECREATION COMMISSION

A Parks and Recreation Commission of the City of Orinda is established. The Commission consists of seven members appointed by the Council. (Prior code § 3-201)

Each member of the Commission shall be a resident of the city. (Prior code § 3-202)

The term of office of each member is three (3) years. Each member serves until a successor is appointed. (Prior code § 3-203) (Ord. No. 11-08, § 2, 7-19-11)

A member of the Commission may be removed by a majority vote of the Council. A vacancy is filled in the same manner as the original appointment.

If a member of the Commission is absent without cause from three (3) successive regular meetings of the Commission, the office becomes vacant automatically. The Commission shall immediately notify the City Council of the vacancy. A member is not absent without cause if the absence is: (1) due to illness; or (2) unavoidable and the member notifies the Secretary of the Commission before the day of the meeting that the member will be absent and gives the reason for the absence. Members of the Parks and Recreation Commission do not receive compensation for attendance at Commission meetings, but are entitled to reimbursement for expenses incurred in the course of their duties out of the city upon approval of the City Council. (Prior code § 3-206)

The Commission shall provide by resolution for the time for holding regular meetings, the appointment of its officers and their duties, and such rules as it considers necessary for the conduct of its business and the performance of its powers and duties. All meetings of the Commission are open to the public and the Commission shall give notice of its meetings as is required by law. (Prior code § 3-207)

Four (4) members of the Commission constitute a quorum for the transaction of business. (Prior code § 3-208)

As used in Section 2.16.100, "park and recreational facilities" means real and personal property, building, improvements, apparatus, facilities and equipment, wherever situated and whether for temporary or permanent use, intended or authorized to be used for park and recreational purposes. (Prior code § 3-209)

The Commission: A.

Shall propose for the consideration of the City Council a municipal parks and recreation program which may include the planning, acquisition, development and maintenance of park and recreation facilities, and the operation of a recreational program; B. Shall on a continuing basis, collect and disseminate information on the park and recreation facilities and programs available to Orinda citizens; C. Shall periodically analyze the needs of the community for recreational facilities of all types, both public and private, and recommend to the City Council appropriate municipal involvement in the financing, acquisition, construction and safe operation of such facilities; D. Shall advise the City Council on the operation of such recreational facilities as may be acquired or leased by the city, including recommendations as to user fees and facility rental charges; E. Shall review the park dedication ordinance and make recommendations to the City Council and Planning Commission regarding changes it considers necessary and proper; F. Shall review the open space, park and recreation elements of the General Plan and make recommendations for change where appropriate to the General Plan Committee and to the City Council; G. Shall make recommendations on supervision of park and recreation facilities; the use, operation and maintenance thereof for recreational purposes; H. Shall adopt rules and regulations for the conduct of Commission affairs; I. May appoint committees of its members to advise and assist it in the performance of its duties; may appoint residents as ex-officio members of special committees. The names of these residents shall be submitted to the City Council prior to appointment; J. Shall advise the City Council, City Manager and the Director of Parks and Recreation in the preparation of the annual budget for park and recreational facilities, park and recreational programs, and a long-range capital improvement program;

K. May hold public hearings regarding the acquisition, construction or development of park and recreation facilities with prior authorization of the City Council; L. May review and make recommendations to the Planning Commission with respect to proposals for major subdivisions or developments which substantially affect park and recreational facilities or park and recreational programs; M. May review all proposals for major subdivisions or developments covered by the park dedication ordinance and make recommendations to the Planning Commission regarding administration of said ordinance in processing the proposal; N. May advise the City Manager regarding the hiring and duties of the Director of Parks and Recreation. (Prior code § 3-210)

The actions of the Parks and Recreation Commission may be subject to review by the City Council. (Prior code § 3-211)
