16.84.070 - Required.¶
Any subdivider who desires the approval of a condominium conversion project shall submit an application which includes the information and documents required by this chapter and such other information determined to be necessary to evaluate the project by the Community Development Director or Planning Agency. (CCCC§ 926-8.202)
16.84.080 - Tentative map and plan.¶
In addition to the tentative map and information required pursuant to Chapter 16.20, a plat plan shall be submitted indicating the location and dimensions of the proposed units, private areas, driveways, parking facilities, walkways, exterior private storage spaces, and common area facilities. This additional information may be set forth on the proposed tentative map in lieu of filing a separate plat plan. (CCCC§ 926-8.204)
16.84.090 - Condominium documents.¶
Draft copies of the required proposed covenants, conditions and restrictions, by-laws, and articles of incorporation of the homeowners association shall be submitted. (CCCC§ 926-8.206)
16.84.100 - Building inspection report.¶
A report from the Building Inspection Department on the condition of any involved buildings listing any regulation violations found to be detrimental to the health, safety and welfare of the public, the owners and the occupants of the building shall be submitted. (CCCC§ 926-8.208)
16.84.110 - Construction details.¶
Construction details of the existing structures indicating common wall, ceiling and floor construction, fire walls and draft wall locations, floor plans and square footage of each unit shall be submitted. (CCCC§ 926-8.210)
16.84.120 - Acoustical report.¶
An acoustical engineer's analysis of current unit- to-unit noise transmission characteristics compared to current Title 15 requirements, including specific recommendations for alterations necessary to meet current Title 15 noise transmission requirements is required. (CCCC§ 926-8.212)
16.84.130 - Physical elements report.¶
A physical elements report shall be submitted on a form developed by the Community Development Department which details the age, condition, useful remaining life of the components of the project and shall include termite, site drainage, roof, plumbing, mechanical, foundation and structural inspection reports. (CCCC§ 926-8.214)
16.84.140 - Tenant profile report.¶
A tenant profile report on the proposed conversion is required and shall include:
A. Length of occupancy of present tenants; B. Household composition; 1. Number and age of tenants over sixty-two (62), 2. Number of tenants receiving Section 8 rental housing assistance, 3. Number and size of families with school age children, 4. Number of handicapped persons in residence, and 5. Number of persons previously displaced by condominium conversions; C. Current rents, a statement of whether rents include or exclude utilities, date and amount of last rental increase during the eighteen (18) months preceding the application; D. Nature of lease agreements; E. Names and addresses of current tenants; F. A report stating the number and date of evictions and reasons for each for the eighteen (18) months preceding the applications; and G. Three sets of stamped, addressed envelopes for each tenant, with no return address. (CCCC§ 926-8.216)
16.84.150 - Notice of intent.¶
Evidence of receipt by each involved tenant of the notice required by Section 16.84.210 is required. (CCCC§ 926-8.218)
16.84.160 - Proposed improvements.¶
A statement of and/or plans for proposed improvements shall be submitted with the application. (CCCC§ 926-8.220)
16.84.170 - Tenant relocation and assistance plan.¶
A tenant relocation and assistance plan which shall contain the following information: A. Proposed amount tenants will be reimbursed for expenses of moving; B. Proposed amount of assistance tenants will be individually given in finding comparable rental housing in the general location of the proposed project; C. The availability of long term leases and extra time to locate housing for families with children in school, students, elderly or handicapped tenants, or long-term tenants; D. Any other plans of the subdivider to provide for assistance to tenants who will be caused to move if the proposed project is approved; and E. For the conversion of a mobilehome park, the impact report required by Government Code Section 66427.4. (CCCC§ 926-8.222)
16.84.180 - Sales information.¶
The following information regarding unit sales shall be provided: A. Proposed sales price of units and financing arrangements; B.
Terms of sale and discounts, if any, to be offered to existing tenants; and C. Statement regarding policy of sales to families with minor children. (CCCC§ 926-8.224)
16.84.190 - Defect and compliance statement.¶
A written statement by the owner and/or subdivider that they are aware of, and will comply with the provisions of Civil Code Section 1134 and this chapter shall be submitted. (CCCC§ 926-8.226)
