3.28.010 - Authority.

This article is enacted under California Government Code Section 66000 et seq. (the Mitigation Fee Act), Section 66477 (the Quimby Act), and the city's general police power. (Ord. 05-06 § 2 Exh. A (part))

3.28.020 - Compliance with general plan and capital improvements plan.

Parks, trails and recreational facilities for which dedication of land or payment of a fee or both are required under this chapter shall be consistent with the open space, parks, schools and utilities element of the Orinda general plan and the city of Orinda capital improvements plan. (Ord. 05-06 § 2 Exh. A (part))

3.28.030 - Definitions.

In this chapter, unless the context other requires: "Affordable housing" means the development of housing for individuals or families of very low, low and moderate income as those terms are defined in California Health and Safety Code Section 50093 (or as it may be amended). "Footprint" means the perimeter of a residence measured where the walls of the residence meet grade.

"Owner" means and includes agent, representative, subdivider, developer or applicant. (Ord. 05-06 § 2 Exh. A (part))
