Chapter 10.52 — PARKING OF COMMERCIAL VEHICLES

The City Council finds that the parking of oversize commercial vehicles, oversized recreational vehicles, boats, trailers, and unattached trailers on public streets can, unless controlled, constitute neighborhood blight and deterioration, impair visibility, constitute a nuisance, and be injurious to the health, safety and general welfare. Therefore the presence of such vehicles on a public right-of-way is prohibited except as permitted in this chapter and is declared to constitute a public nuisance. This chapter is adopted under section 22507.5 of the California Vehicle Code. (Ord. 00-06 § 2 (part))

In this chapter unless the context otherwise requires: "Commercial vehicle" means vehicle of a type required to be registered under that State Vehicle Code used or maintained for the transportation of persons for hire, compensation or profit, or designated, used or maintained primarily for the transportation of property.

"Oversize vehicle" means vehicle or a vehicle and trailer combination which has a manufacturer's gross weight rating of ten thousand (10,000) pounds or more or the dimensions of which exceed twenty (20) feet in length or seven feet in height. "Oversize recreational vehicle" means vehicle, other than an automobile, which is self-propelled, motorized, and has self-contained living quarters, including a kitchen, bathroom and sleeping areas, and may be used for the transportation of people upon a street or highway, but not including any vehicle designed for travel on stationary rails or tracks. This definition also includes motor homes and travel trailers. "Residential district" means single-family residential, very low, low and medium density residential districts established under Chapter 17.3 of this code. (Ord. 00-06 § 2 (part))

Except as provided in Section 10.52.040, no person within the city may park or leave standing an oversized commercial vehicle as follows: A. Upon any public street between the hours of two a.m. and six a.m.; or B. In a residential district, as defined in Section 10.52.020, at any time. (Ord. 00-06 § 2 (part))

A. The parking prohibition of Section 10.52.030 does not apply to a commercial oversize vehicle making pickups or deliveries of goods, wares or merchandise or delivering building materials to a site for which a building permit has been previously been obtained and posted. B. The parking prohibition of Section 10.52.030 does not apply to oversized recreational vehicles holding a city-issued permit for twenty-four (24) hours. Guests of a resident can obtain a permit for seven days. The seventy-two (72) hour vehicle code section does not apply in this situation. (Ord. 00-06 § 2 (part))

Signs announcing the parking prohibition in this chapter, and giving notice of removal under Section 22651(m) of the California Vehicle Code, shall be posted at major entry points to the city. This chapter applies only after such notice is posted.

Violation of this chapter is an infraction, punishable under Section 10.04.060 of this code. In addition, under Section 22651(m) of the California Vehicle Code, the city may remove a vehicle parked or left standing in violation of this chapter. (Ord. 00-06 § 2 (part))

A. Parking permits shall be issued by the Police Department. No more than one permit shall be issued to each motor vehicle for which an application is made. B. Parking permits may be issued for an oversized recreational vehicle of a legal resident whose oversized recreational vehicle is to be parked for twenty-four (24) consecutive hours or less, in front of his/her residence for the purpose of loading or unloading before or after a trip. The term trip does not refer to the daily use of the vehicle, but instead refers to an extended overnight use of the vehicle which requires additional time to prepare the vehicle. C. Parking permits may be issued to a bona fide guest of a resident who is not a resident himself/herself, whose oversized recreational vehicle will be parked in front of an Orinda residence for the period of time up to seven days. D. Permits shall be displayed by being placed on the dash area of the vehicle or taping the permit on the inside of the front windshield, both visible from outside the vehicle. (Ord. 00-06 § 2 (part))
