Chapter 10.44 — STOPPING, STANDING AND PARKING—PROHIBITED OR RESTRICTED

10.44.010 - Authority to establish—Enforcement—Obedience.

A. The City Council may by establish no-stopping zones, no-parking areas, and restricted-parking areas, as defined and described in this chapter, by resolution. B. No prohibition or restriction relating to stopping, standing or parking imposed under this chapter shall be effective unless appropriate signs of markings required by the California Vehicle Code are in place. C. It is unlawful for any operator of a vehicle to disobey the provisions of this chapter when appropriate signs or markings are in place. (Ord. 00-06 § 2 (part))

10.44.020 - Application of chapter.

A.

The provisions of this chapter prohibiting the stopping, standing or parking of a vehicle shall apply at all times, or at those times specified in this chapter, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer, authorized police employee, or official traffic-control device. B. The provisions of this chapter or other regulations imposing a time limit on standing or parking shall not relieve any person from the duty to observe other and more restrictive provisions of the Vehicle Code or the regulations of the city prohibiting or limiting the standing or parking of vehicles in specified places or at specified times. 10.44.030 - Restrictions established—Signs designating.

A. The City Council may establish such parking, or stopping, standing and parking restrictions or prohibitions as may be necessary, and the City Manager shall designate such streets, portions of streets, or city-owned parking facilities by appropriate signs or markings giving effect to such parking or stopping, standing and parking restrictions or prohibitions. In addition, the City Manager may establish such parking, or stopping, standing and parking restrictions or prohibitions for periods of time not to exceed four months at which time such restrictions or prohibitions shall no longer be of any force and effect unless duly established by ordinance or resolution of the City Council. The City Manager shall designate streets or portions of streets by appropriate signs or markings, giving effect to such parking or stopping, standing and parking restrictions or prohibitions. B. When a sign authorized by this section is in place, no person shall stop, stand or park any vehicle in violation of the sign. C. Whenever the stopping, standing or parking of a vehicle has been prohibited, restricted, or limited as to time, the continued standing or parking of such vehicle after a citation has been issued shall constitute a separate and additional violation of the provision for which the citation was issued, when such standing or parking continues for an additional period longer than the maximum permissible period of parking in such space or location after issuance of such citation, or if no such period of time is designated, when such stopping, standing or parking after a citation continues for an additional period longer than one hour. 10.44.040 - Definitions.

A. For the purposes of this chapter, the following words shall have the following meanings:

"Camper shell" means a structure designed to cover or protect the bed area of a pickup truck but which is separated from the truck. "Oversized vehicle" means any vehicle exceeding seven feet in height or exceeding twenty (20) feet in overall length or exceeding seven feet in width (including any load or accessory thereon other than antennas), provided that this definition shall not apply to vehicles which exceed these dimensions solely because of modifications required to accommodate a disability and the vehicle is lawfully displaying a disabled placard or license. "Public facility zone" means all lands located within the PS District, the Public, Semi-public and Utility District; where one side of a street is located within a public facility zone, then the portion of the opposite side of the street directly across from the public facility zone shall also be included in the restrictions pertaining to a public facility zone. "Residential district" means all lands located within the following zoning districts: RVL-E, RVL, RL-40, RL- 20, RL-15, RL-12, RL-10, RL-6 and RM; where one side of a street is located within one of these residential districts, then the portion of the opposite side of the street directly across from the residential district shall also be included in the definition of a residential zone. "Trailer" means a vehicle designed or utilized for being drawn by a motor vehicle. (Ord. 00-06 § 2 (part))

10.44.050 - Stopping and parking prohibited.

No operator of any vehicle shall stop, stand, park, or leave standing such vehicle in any of the following places except when necessary to avoid conflict with other traffic or in compliance with the direction of a police officer or other authorized officer, or traffic sign or signal: A. Within an intersection, except adjacent to curbs as may be permitted by city ordinance; B. Within a crosswalk, including any portion of the white divisional boundaries of a crosswalk, except that a bus engaged as a common carrier or a taxicab may stop in an unmarked crosswalk to load or unload passengers when authorized by the City Council pursuant to an ordinance; C. Within any portion of a curb marked by local authorities with red paint; D. Within fifteen (15) feet of the driveway entrance to any fire station, except any vehicle owned or operated by a fire department and clearly marked as a fire department vehicle; E.

In front of a public or private driveway, except that a bus engaged as a common carrier, schoolbus, or a taxicab may stop to load or unload passengers when authorized by local authorities pursuant to an ordinance; F. On any portion of a sidewalk, or with the body of the vehicle extending over any portion of a sidewalk, except electric carts when authorized by city ordinance. Lights, mirrors, or devices that are required to be mounted upon a vehicle under this code may extend from the body of the vehicle over the sidewalk to a distance of not more than ten inches; G. On any roadway or public parking facility owned or controlled by the city so as to obstruct the normal movement of traffic or in a condition so as to create a hazard or obstruct the free use of such street, alley, or public parking facility. This section shall not replace removal pursuant to section 22651(B) of the California Vehicle Code; H. On the roadway side of any vehicle stopped, parked, or standing at the curb or edge of a roadway, except for a school bus when stopped to load or unload pupils in a business or residence district where the speed limit is twenty-five (25) miles per hour or less; I. Except as provided in section under CVC 22500.5 alongside curb space authorized for the loading and unloading of passengers of a bus engaged as a common carrier in local transportation when indicated by a sign or red paint on the curb erected or painted by city authorities pursuant to ordinance; J. Upon a bridge, except authorized vehicles, being used in the repair, maintenance, or inspection of the facility, and except that buses engaged as a common carrier in local transportation may stop to load or unload passengers upon a bridge where sidewalks are provided, when authorized by city officials pursuant to an ordinance, and except that city authorities pursuant to an ordinance may permit parking on bridges having sidewalks and shoulders of sufficient width to permit parking without interfering with the normal movement of traffic upon the roadway. Parking shall not be permitted unless there are signs in place, as may be necessary, to indicate the provisions of local ordinances; K. In front of that portion of a curb that has been cut down, lowered, or constructed to provide wheelchair accessibility to the sidewalk and that is designated for wheelchair access by either sign or red paint on the curb pursuant to an ordinance of the city. 10.44.060 - Curb parking.

A. Except as otherwise provided in this chapter, every vehicle stopped or parked upon a roadway where there are adjacent curbs shall be stopped or parked with the right-hand wheels of such vehicle parallel with and within eighteen (18) inches of the right-hand curb, except that motorcycles shall be parked with at least one wheel or fender touching the right-hand curb. Where no curbs or barriers bound any roadway, right-hand parallel parking is required unless otherwise indicated. B. The provisions of subsections A or E of this section do not apply to a commercial vehicle if a variation from the requirements of subsections A or E of this section is reasonably necessary to accomplish the loading or unloading of merchandise or passengers on, or from such vehicle and while anything connected with such loading, or unloading is being executed. C. This subdivision shall not be construed to permit any vehicle to stop or park upon a roadway in a direction opposite to that in which traffic normally moves upon that half of the roadway on which such vehicle is stopped or parked. This subdivision does not permit any vehicle to cause other traffic to pass where passing is prohibited. D. Notwithstanding the provisions of subsection B of this section, city officials may, by ordinance, prohibit commercial vehicles from stopping, parking, or standing on one side of a roadway in a business district with the wheels of such vehicle more than eighteen (18) inches from the curb. The ordinance shall be effective only if signs are placed in the areas to which it is applicable clearly indicating the prohibition (CVC 22502c). E. This section does not apply to vehicles of a public utility when such vehicles are being used in connection with the operation, maintenance, or repair of facilitates of the public utility or are being used in connection with providing public utility service. F. Upon a one-way roadway, vehicles may be stopped or parked as provided in subsection A of this section or with the left-hand wheels parallel to and within eighteen (18) inches of the left-hand curb, except that motorcycles, if parked on the left-hand side, shall have either one wheel or one fender touching such curb. Where no curb or barriers bound any such one-way roadway, parallel parking on either side is required unless otherwise indicated. (Ord. 00-06 § 2 (part))

10.44.070 - Time limit parking.

When authorized signs are in place, no operator of any vehicle shall stop, stand or park such vehicle during the times such signs are in effect for a period longer than designated on the sign. This section shall not apply to any publicly owned vehicle, authorized emergency vehicle, or any vehicle exempted under CVC 22511.5. (Ord. 00-06 § 2 (part))

10.44.080 - Parking on curbless streets.

No person shall stop, park or leave standing any vehicle, whether attended or unattended, upon the roadway when it is practicable to stop, park or leave the vehicle off such portion of the street, but in every event an unobstructed width of the street opposite a standing vehicle shall be left for the free passage of other vehicles and a clear view of the stopped vehicle shall be available from a distance of two hundred (200) feet in each direction upon the street. The provisions of this section shall not apply upon a street where the roadway is bounded by adjacent curbs. (Ord. 00-06 § 2 (part))

10.44.090 - Parking prohibited on grade.

No person shall park or leave a vehicle standing unattended on a highway when upon any grade exceeding three percent within any business or residential district without blocking the wheels of the vehicle by turning them against the curb or by other means. (Ord. 00-06 § 2 (part))

10.44.100 - Temporary parking and street sweeping restrictions.

A. Whenever the Chief of Police, Director of Public Works, or Director of Utilities determines that traffic congestion or conflict is likely to result from construction or maintenance work, the holding of public or private assemblages, gatherings or functions or for the movement of equipment, articles, or structures of unusual size interfering with normal flow of traffic, those officials shall have power and authority to restrict the operation, parking or standing of vehicles at the particular streets, alleys, or public parking facilities (and for the duration) determined to be necessary or desirable to avoid such traffic congestion or conflict. No person shall operate, park, or leave standing any vehicle in violation of such restrictions where temporary signs, devices or barricades are erected or posted indicating that the operation, parking or standing of vehicles is restricted. B. Whenever the Director of Public Works determines that parking or standing of vehicles on any city street, alley, or public parking facility should be prohibited or restricted for the purpose of street sweeping, no vehicle shall be parked or allowed to stand on any portion of the street, alley, or public parking facility in violation of signs posted for that purpose, and removal of vehicles parked in violation of such signs is authorized. C.

When signs, devices or barricades authorized by the provisions of this section are in place, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. Whenever signs are erected or placed at least twenty-four (24) hours in advance of the prohibition against parking or standing and those signs warn that removal is authorized for violation of the prohibition, the Chief of Police is authorized to remove vehicles parking or standing in violation of the prohibition. Whenever a vehicle is removed pursuant to this section and is stored as permitted by the California Vehicle Code, the Chief of Police shall comply with the requirements of Section 22852 of the California Vehicle Code relating to post- storage notice and hearing for registered owners and legal owners of record. 10.44.110 - Requiring ignitions locked and keys removed from motor vehicles.

A. No person driving or in charge of a motor vehicle shall allow it to stand unattended on any highway, public street, or any other public place, or on a parking facility open to the public use, without first stopping the engine, locking the ignition and removing the ignition key from the vehicle. The registered owner of a vehicle found in violation of this section shall be held prima facie responsible for any such vehicle. Violation of this section shall not mitigate the offense of theft of such motor vehicle. B. This section does not apply to authorized emergency vehicles, publicly owned vehicles, public utility vehicles, or road construction vehicles while engaged in the performance of their duties. 10.44.120 - Vehicle alarm sounding.

Any vehicle found on public or private property, or a public roadway with an alarm device or horn that has been sounding, whether continuously or intermittently and repeatedly activated for a period in excess of twenty (20) minutes is declared a public nuisance and may be issued a citation or towed, or both, in accordance with Section 22651.5 of the California Vehicle Code. 10.44.130 - Exception to chapter provisions.

In addition to the provisions of this chapter, the City Manager may grant permission to organizations and individuals to park vehicles, materials or equipment for special occasions in violation of municipal parking prohibitions or time limits. (Ord. 00-06 § 2 (part))
