Article 2 — Building Permit Conditions

15.32.060 - Compliance required.¶
The provisions of this article are imposed as conditions to each building permit issued by the city. The City Engineer shall require compliance with these provisions. (Prior code § 4-110)
15.32.080 - Street protection.¶
An applicant may not place, maintain or operate steel-tracked grading or construction equipment with cleats on a public or private street without placing protective material beneath the equipment to protect the surface of the street. (Prior code § 4-112)
15.32.090 - Bond.¶
The City Engineer shall require the owner to post a bond to secure payment for damage to a city street caused by construction activity in connection with work authorized by the permit. The City Engineer may waive this requirement when the construction activity will not foreseeably damage the street. (Prior code § 4-113)
15.32.100 - Trash storage.¶
A. Trash, scrap and debris shall be stored in a container on the construction site. B. No person shall place or maintain a container in the public right-of way without an encroachment permit. (Prior code § 4-114)
15.32.110 - Portable sanitary facilities.¶
No person shall place, install or maintain a portable sanitary facility on a construction site closer to the property line than the building setback line. (Prior code § 4-115)
15.32.120 - Parking.¶
The City Engineer may temporarily prohibit or restrict stopping, parking or standing of vehicles along a street abutting a construction project where necessary for public safety. The restriction does not apply until the City Engineer places a sign or marking at the site. The special restriction shall be limited to the duration of the project. This section is adopted under California Vehicle Code Section 22507.5. (Prior code § 4-116)
15.32.130 - Carpooling.¶
Upon issuance of a building permit, the City Engineer shall request carpooling to a construction site. (Prior code § 4-117)
15.32.140 - Encroachment permit required.¶
When an encroachment permit is required for an activity in a public right-of-way, the City Engineer shall require the encroachment permit as a condition of obtaining the building permit. (Prior code § 4-118)
15.32.150 - Truck route.¶
The City Engineer may designate a truck route for ingress and egress from the property during the term of the building permit upon findings that: A. The designation of the truck route will minimize the impact of the construction such as noise, dust, traffic safety hazards and potential damage to pavement on a residential street; B. Designation of the truck route will not unreasonably impair the contractor's access to the site or cause undue economic hardship. (Prior code § 4-119)
15.32.160 - Street rehabilitation.¶
The City Engineer shall require an applicant for a building permit for a major improvement to rehabilitate the street pavement along the frontage of the property from the edge of the street to the center of the right-of- way. (Prior code § 4-120)
15.32.170 - Drainage.¶
Upon a finding that the existing drainage improvements are inadequate or need repair, the City Engineer shall require an applicant for a building permit for a major improvement to make one or more of the following drainage improvements along the frontage:
A. Installation of a storm drain to replace a deep open drainage ditch; B. Installation of a debris rack at each drainpipe inlet; C. Installation of a paved ditch; and D. The repair of an existing rock and mortar ditch. (Prior code § 4-121)
15.32.180 - Minimum paving requirements.¶
The minimum width of paving on public and private streets shall be as shown in the following table: Class of Street Minimum Width of Paving With Parking Without Parking Public Arterial As required by the City Engineer Collector 40 feet 28 feet Local 36 feet 20 feet Private Driveway serving no more than 1 unit and no longer than 600 feet 12 feet 12 feet Street Serving less than 4 homes and less than 600 feet in length 32 feet 16 feet

The right-of-way shall extend a minimum of ten feet from the pavement. (Prior code § 4-122)
15.32.190 - Pavement widening.¶
The City Engineer shall require as a condition of a building permit for a major improvement that the applicant widen the public or private street along the property frontage so that it either: (1) meets current standards for pavement width as set forth in Section 15.32.180; or (2) matches the width of the existing street in the vicinity of the property if widening to current standards is unreasonable. The City Engineer shall impose this condition upon a finding that: (1) the existing street is so narrow that it creates a safety hazard for pedestrians or vehicles; (2) the existing street fronting the applicant's property is narrower than other sections of the street in the same vicinity; or (3) increasing the width of the street is not an unreasonable burden given the topography of the area and the cost of the work. 15.32.200 - Street extension.¶
The City Engineer shall require that a street extension to the property meet the applicable city road standard set forth in Section 15.32.180. The City Engineer may modify this standard based upon unique topography which makes current city standards impractical or impossible. (Prior code § 4-124)
15.32.210 - Curb and gutter requirements.¶
A. New Single-Family Development. When required for: (1) continuity of existing curb and gutter; (2) street drainage; or (3) to ensure structural support for the edge of the street pavement, the City Engineer shall require that an applicant for a building permit in a single-family residential district install rolled/mountable curb and gutter along the side of each abutting street. B. New Commercial and Multifamily Development. The City Engineer shall require that an applicant for a building permit in a commercial or multi-family district install vertical curb and gutter along the frontage of each abutting street. C. Color Requirements. New curb and gutter shall be tinted to match existing adjacent concrete, or in the absence of adjacent concrete shall be tinted dark grey.

15.32.220 - Street lighting.¶
A. Street lighting is allowed in a residential area with the approval of the City Engineer but only where necessary to prevent a hazard for pedestrians or traffic. B. Street lighting is required for major improvement to an existing commercial, multifamily or institutional structure. C. When street lighting is installed, the illumination design must mitigate impacts on surrounding areas in a manner prescribed by the City Engineer. (Prior code § 4-126)
15.32.230 - Path or sidewalk in single-family and multifamily land use districts.¶
A. The City Engineer shall require dedication and construction of a path or sidewalk in a single-family or multifamily land use district when: 1. A path or sidewalk is consistent with the city master list of trails, pedestrian and bicycle paths formulated as required by the general plan; or 2. A path or trail is necessary to afford safe pedestrian access to a bus stop or other public facility. B. As a condition to issuance of a building permit for new development in the vicinity of a school serving grades kindergarten through 12, the City Engineer shall require dedication and construction of a path or sidewalk along the street or road abutting the property. C. When required to dedicate and construct a path or sidewalk, an applicant shall provide the path or sidewalk on at least one side of the street or road abutting the property. (Prior code § 4-127)
15.32.240 - Path or sidewalk in commercial land use district.¶
The City Engineer shall require dedication and construction of a path or sidewalk along at least one side of each street abutting the property in a commercial land use district. (Prior code § 4-128)
15.32.250 - Guidelines for path construction.¶
To the extent feasible, the City Engineer shall follow the following guidelines when requiring the dedication and construction of a path or sidewalk: A. The path or sidewalk shall not be built contiguous to the street or road; B. The path or sidewalk shall connect to another off-site sidewalk or path; C. Each path and sidewalk shall meander; D. A path or sidewalk need not follow the roadway alignment. (Prior code § 4-129)
15.32.260 - Use of pedestrian and bike paths.¶
The City Engineer shall require that a pedestrian and bike path be left unobstructed for use by pedestrian and bike travel. (Prior code § 4-130)
15.32.270 - Dedication of right-of-way.¶
Where the conditions set forth in this chapter require the construction of street, path or frontage improvements outside the existing right-of-way, the owner shall dedicate an additional right-of-way for these improvements. (Prior code § 4-131)
