Montebello Municipal Code Ch. 10.08 Definitions

The following words and phrases when used in this title shall have the meanings respectively ascribed to them in this title. Whenever any words or phrases used in this title are not defined herein, but are now defined in the Vehicle Code of this state, such definitions are incorporated herein and shall be deemed to apply to such words and phrases used herein as though set forth herein in full.

"Caltrans" means the Department of Transportation of the state of California, or its successor agency.

"City" means the city of Montebello.

"Commuter vehicle" means a motor vehicle parked in a residential area which is not owned, leased or otherwise controlled by:

A. A resident who lives in the area designated as a preferential parking district;

B. A merchant whose business establishment is located in the area designated as a preferential parking district;

C. A guest visiting residents living in the area designated as preferential parking district.

"CVC" means the latest edition of the state of California Vehicle Code.

"Director of public works" means the director of public works of the city of Montebello, or his/her authorized representative.

"Interstate truck" means truck tractor and semitrailer or truck tractor, semitrailer and trailer authorized to operate on designated highways by Section 35401.5 of the California Vehicle Code.

"Loading zone" means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials.

"Merchant" means a person, who as proprietor, operates a commercial business within a preferential parking district.

"Official time standard." Whenever certain hours are named herein, they shall mean standard time or daylight savings time as may be current.

"Official traffic control device" means all signs, signals, markings and devices not inconsistent with this title, placed or erected by authority of a public body or official having jurisdiction for the purpose of regulating, warning, guiding traffic.

"Official traffic signal" means any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and proceed and which is erected by authority of a public body or official having jurisdiction.

"Parkway" means that portion of a street other than a roadway or sidewalk.

"Passenger loading zone" shall mean the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers.

"Pedestrian" means any person on foot.

"Police chief" means the police chief of the city of Montebello, or his/her authorized representative.

"Preferential parking district" means a residential area with streets and boundaries designated by a city council resolution, wherein vehicles displaying a valid permit shall be exempt from parking restrictions established pursuant to this title.

"Resident" shall mean a person who lives in a dwelling.

"Terminal" means any facility at which freight is consolidated to be shipped or where full-load consignments may be loaded and off-loaded for shipment to final delivery points.

"Traffic" means any pedestrians, ridden or herded animals, vehicles and other conveyances either singly or together while using any street for purposes of travel.

"Truck yard" means any facility or service point at which trucks are regularly maintained, stored or manufactured.
