4.16.010 - Certain social gatherings unlawful.

A. No person under the age of twenty-one years shall have in his or her possession or consume any alcoholic beverage at any place not open to the public, unless that person is accompanied by and is being supervised by his or her parent or legal guardian.

B. No person shall suffer, permit, allow, or host a social gathering at his or her place of residence where one or more persons under the age of twenty-one (21) are present and alcoholic beverages are in the possession of, or being consumed by, any person under the age of twenty-one (21) years who is not accompanied by and under the supervision of his or her parent or legal guardian.

4.16.020 - Disturbance requiring a second police response; liability for costs.

Where a disturbance occurs at a premises which is determined by an officer of the City Police to constitute a threat to the public peace, health, safety or general welfare, and a second response by an officer of the City Police to such disturbance is made, the officer utilized during the second response shall be deemed to be on special security assignment over and above the services normally provided.

The person or persons in charge of the premises and the person or persons responsible for the event, or if any of those persons is a minor, then the parents or legal guardians of that minor, shall be jointly and severally liable for the cost of providing the officer on special security assignment.

The cost of the special security assignment shall include the cost of police response, damage to City property and injuries to City personnel, and shall be determined according to rates and charges as established from time to time by resolution of the City Council.

The terms "police officer" or "police response" shall refer to and include Los Gatos-Monte Sereno Police Department.
