4.06.020 - Issuance of permits.¶
Residential Parking Permits shall be issued by the City Clerk. Parking Permits may be issued to an owner or resident of property within a Residential Parking Permit Area, provided that a Residential Parking Permit shall only be issued to an owner, or resident who has a motor vehicle currently registered in his or her name, or who has lawful possession of a motor vehicle for his or her exclusive use and/or which is under his or her control. Not more than one Residential Parking Permit shall be issued for any motor vehicle. The City Clerk may establish rules and regulations necessary or appropriate to carry out the purpose of this Chapter. The City Clerk shall require each applicant for a Residential Parking Permit to establish proof of residency and vehicle ownership, possession or control in compliance with this Chapter. All permits issued pursuant to this Chapter shall remain the property of the City of Monte Sereno.
4.06.030 - Duration and limit on number of permits to be issued.¶
There shall be no more than one (1) Permit issued for each motor vehicle at any residential address within a Residential Permit Parking Area. A separate application shall be filed for each motor vehicle.
4.06.040 - Visitor parking permits.¶
Not more than two (2) Visitor Parking Permits shall be issued to the resident for visitors at any dwelling unit. Visitor Parking may be issued at the same time as the annual Residential Parking Permit. The maximum number of Visitor Parking Permits per premises is two, notwithstanding the number of residents or owners. Additional temporary Visitor Parking Permits may be issued for a specific date and times on that date.
4.06.050 - Display of permits.¶
All Parking Permits shall be placed inside the vehicle, visible through the front windshield on the driver's side.
4.06.060 - Fees for issuance; duration of permits.¶
The Council may establish by Resolution fees for the issuance of Residential parking Permits, Visitor Parking Permits and for the replacement of lost, damaged, or destroyed Permits. Residential Parking Permits shall be valid for not more than one (1) year, unless otherwise stated on the Permit and every Permit shall be renewable prior to January 10th of each year. The City Clerk shall cause to be prepared each year a distinctively colored permit for issuance to permittees of Residential Parking Permits, and Visitor Parking Permits, which permit shall be affixed to the motor vehicle for which a Permit is issued at the location specified in Section 4.06.050
4.06.070 - Termination of permits.¶
Residential or Visitor Parking Permits shall terminate upon any of the following events:
A. Upon the transfer or sale of the vehicle for which a Permit has been issued.
B. Upon the relocation of the permittee from his or her residence within a Residential Parking Area to another residence, whether within or outside said Area.
C. Upon expiration of the calendar year for which a Permit has been issued.
4.06.080 - Posting of residential permit parking area.¶
Upon the adoption of a Resolution by the City Council upon the recommendation of the City Manager designating a Residential Permit Parking Area, the City Engineer shall order appropriate signs to be erected in such area indicating prominently thereon the time limitation, day or days, and hours during which parking shall be restricted to vehicles for which Residential Parking Permits have been issued.
4.06.090 - Violations.¶
A. It is unlawful and a violation of this Chapter, unless expressly provided to the contrary herein, for any person to park a motor vehicle on a street in a Residential Permit Parking Area at any time on any day or night of the year or in excess of the posted time restrictions on that street if, in fact, less restrictive parking time limits are ordered for and posted on the street, as the case may be, without a valid Residential Parking Permit properly affixed to such vehicle.
B. No person shall park a motor vehicle within a Residential Permit Parking Area with a Residential Parking Permit affixed to such vehicle evidencing that such Permit has expired or which has been terminated or is not valid for the Area in which such vehicle has been parked.
C. It is unlawful and a violation of this Chapter for a person falsely to represent himself or herself as eligible for a Residential Parking Permit or a Visitor Parking Permit or to furnish false information in an application for any such Permits.
D. It is unlawful and a violation of this Chapter for any person to use or display, or permit the use or display of, a Residential Parking Permit pertaining thereto on a motor vehicle other than that vehicle for which such Permit was issued.
E. It is unlawful and a violation of this Chapter for any person in legitimate possession or control of a Visitor Parking Permit to sell, lend, or otherwise permit the use or display of that Permit for the purpose of profit or favor.
F. The issuance of a Residential Parking Permit or Visitor Parking Permit does not permit any person to park that vehicle upon any street during those hours in which parking is prohibited for street sweeping, road repair, or during emergencies.
4.06.100 - Exemptions.¶
A. Any motor vehicle on which is displayed a valid Residential Parking Permit or Visitor Parking Permit may be parked on a street in the Residential Permit Parking Area pertaining thereto without being subject to the time restrictions established in Section 4.06.090 Such Parking Permit shall not guarantee or reserve to the holder thereof an on-street parking space on a street in such Residential Permit Parking Area.
B. This Chapter shall not apply to ambulances, fire department vehicles, Police vehicles, public utility vehicles, or other official or emergency vehicles.
C. This Chapter shall not apply to commercial vehicles parked for the purpose of loading or delivery of goods, wares, or merchandise from or to any building or structure in a Residential Parking Permit Area or delivering materials to be used in the repair, alteration, remodeling, construction, or reconstruction, of any such building or structure for which a building permit has previously been obtained.
4.06.110 - Violations, penalties: enforcement.¶
Any person found guilty of violating any provision of this Chapter shall be deemed guilty of an infraction, and each day of such violation shall constitute a separate infraction.
