Marin County Municipal Code Ch. 15.53 Fire and Hiking Trails

15.53.010 - Definitions.

The following words when used in this chapter shall be deemed to have the following meanings:

MOTOR VEHICLE. "Motor vehicle" means and includes any wheeled conveyance of any type whatsoever, which is motor-powered, including but not limited to, motorcycles, motor bikes, automobiles and trucks.

FIRE TRAIL. "Fire trail" means any road, path, clearing, graded area or right-of-way established and/or maintained on public or private property primarily for fire fighting and/or fire protection purposes.

HIKING TRAIL. "Hiking trail" means any road, path, clearing, graded area, track or right-of-way established and/or maintained on public or private property primarily for hiking, camping and public recreation purposes.

15.53.020 - Illegal use of fireroads and firebreaks.

No person, except a public officer acting within the scope of his duties, shall travel upon or drive or park any motorcycle, motorscooter or motor vehicle upon any fireroad or firebreak, as defined in Title 16 of this code, without the permission of the property owner or owners involved. No person shall park any vehicle so as to obstruct the entrance to any fireroad or firebreak.

15.53.025 - Fire roads, parking thereon.

The chief, any designated member of the fire department or any peace officer as defined in Penal Code Sections 830.1 or 830.2 may have a vehicle removed, at the owner's expense, when in violation of Uniform Fire Code Section 10.205 (parking on fire roads), Section 10.206 (obstruction of fire protection equipment), Section 10.207 (access roadways for fire apparatus), Section 15.53.020 Marin County Code (illegal use of fire roads and firebreaks) or when the vehicle may be considered a potential hazard such as leaking fuel, butane, propane or any other substance that may be flammable, explosive or toxic.

15.53.040 - Enforcement.

Any employee of the Marin County fire department or any other duly constituted public agency having jurisdiction over a fire trail or hiking trail, shall be deemed to be a peace officer for the purpose of enforcing this chapter.

15.53.050 - Penalty for violations.

Any person violating any of the provisions of this chapter is guilty of a misdemeanor and upon conviction thereof shall be subject to a fine of not less than twenty-five dollars, but not exceeding one hundred dollars, or imprisonment for a period not to exceed one month, or by both said fine and imprisonment.

15.53.100 - Park rangers permitted to enforce parking regulations.

The following designated employee positions are authorized to enforce the provisions of all California Vehicle Code sections, Marin County ordinances and Marin County resolutions regulating parking on Marin County parks' land as defined in Title 10 of the Marin County Code by the issuance of parking citations. The designated employee positions are:

A. Park ranger;

B. Senior park ranger;

C. Chief park ranger.
