Editor's note— Ord. No. 515, § I, adopted December 3, 2019, repealed the former Chapter 15.24, §§ 15.24.010—15.24.120, and § II of Ord. No. 515 enacted a new Chapter 15.24 as set out herein. The former Chapter 15.24 pertained to similar subject matter and derived from Ord. No. 490, adopted March 7, 2017.

15.24.010 - California Existing Building Code—Adopted by reference.

The 2019 edition of the California Existing Building Code, Title 24, Part 10, including tables, based on the 2018 International Existing Building Code, as adopted by the California Building Standards Commission in Title 24, Part 10 of the California Code of Regulations, and all future amendments thereto, are hereby adopted in the City of Ione. A copy of this code is available for use and examination by the public at the Office of the Clerk of the City of Ione.

15.24.020 - Fees.

Section 1.8.4.2, Fees of the 2019 California Existing Building Code is amended to read as follows:

Permit fees and plan check fees are as set forth by the City Council.

15.24.030 - Work exempt from a permit—Building.

Section 105.2, work exempt from a permit — building, of the 2019 California Existing Building Code is amended by adding a sentence to read as follows:

Any work that is exempt from a building permit shall remain subject to other applicable City ordinances, resolutions, and regulations, including, but not limited to, the City's Subdivision Ordinance, Zoning Code, and design review requirements.

15.24.035 - Work exempt from a permit—Building exception 5.

Section 105.2 Building exception #5 is amended to read as follows:

Building #5. Window awnings supported by an exterior wall of Group R-3 or Group U occupancies, supported by an exterior wall that do not project more than 54 inches from the exterior wall and do not require additional support.

15.24.040 - Site plan.

Section 106.2.6, site plan of the 2019 California Existing Building Code is amended to read as follows:

The construction documents submitted with the application for permit shall be accompanied by a site plan showing to scale the size and location of new construction and existing structures on the site, distances from lot lines, the established street grades and the proposed finished grades and, as applicable, flood hazard areas, floodways, and design floor elevations; and it shall be drawn in accordance with an accurate verifiable boundary line(e.g. a recorded parcel map, final map, deed, etc.). If no verifiable boundary line can be established, a survey may be required. In the case of demolition, the site plan shall show construction to be demolished and the location and size of existing structures and construction that are to remain on the site or plot. The Building Official is authorized to waive or modify the requirement for a site plan where the application for permit is for alteration, repair or change of occupancy.

15.24.050 - Amended construction documents.

Section 106.4, amended construction documents of the 2019 California Existing Building Code is amended to read as follows:

Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents and shall pay a new plan review fee as set forth by the City Council.

15.24.060 - Retention of construction documents.

Section 106.5, Retention of construction documents of the 2019 California Existing Building Code is amended to read as follows:

One set of approved construction documents shall be retained by the Building Official for a period of not less than 180 days from date of completion of the permitted work, or as required by state or other applicable City ordinances, resolutions, and regulations.

15.24.070 - Schedule of permit fees.

Section 108.2, schedule of permit fees of the 2019 California Existing Building Code is amended to read as follows:

All permit fees to include Building, Fire, Electrical, Mechanical, and Plumbing, shall be in accordance with the schedule of fees adopted by resolution of the City Council from time to time. When a plan or other data are required to be submitted, a plan review fee shall be paid at the time of submitting plans and specifications for review. Plan review fees will be in addition to building permit fees for building, electrical, mechanical and plumbing work and shall be established by the City's Building Division Fee Schedule established by resolution of the City Council. Where plans are incomplete or changed so as to require additional plan review, an additional plan review fee shall be charged in accordance with the schedule established by the City Council for such fee.

15.24.080 - Work commencing before permit issuance.

Section 108.4, Work commencing before permit issuance of the 2019 California Existing Building Code is amended to read as follows:

Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to an additional investigation fee as set forth by the City Council from time to time. An investigation fee shall be in addition to required permit and plan review fees. An investigation fee shall be collected whether or not a permit is subsequently issued. Payment of investigation fees shall not exempt any person from compliance with all other provisions of this code, or any other City, State, or Federal codes, statutes, and ordinances, or from any penalty prescribed by law.

15.24.090 - Lath or gypsum board inspection.

Section 109.3.5, Lath or gypsum board inspection of the 2019 California Existing Building Code is amended to read as follows:

Lath, gypsum board and gypsum panel product inspections shall be made after lathing, gypsum board and gypsum panel products, interior and exterior, are in place, but before panel product joints and fasteners are taped and finished.

Exception: Gypsum board and gypsum panel products that are not part of a fire-resistance-rated assembly or a shear assembly.

15.24.100 - Code official definition.

Section 202, Code Official definition of the 2019 California Existing Building Code is amended to read as follows:

The officer or other designated authority charged with the administration and enforcement of this code shall be the Building Official.

15.24.110 - Enforcement.

The California Existing Building Code herein adopted shall be enforced by the Building Department of the City of Ione.

15.24.120 - Penalties.

In the event that initial administrative remedies in the California Building Standards Code (Title 24) are not successful in achieving compliance, then Article II (Code Enforcement) of Chapter 1.10 of Title 1 of the Ione Municipal Code (IMC), IMC Title 1, Chapter 1.08 (General Penalty), and IMC Title 1, Chapter 1.10 (Administrative Enforcement Provisions), will be followed for enforcement of penalties. The application of a penalty shall not be held to prevent the enforced removal of prohibited conditions.
