Editor's note— Ord. No. 489, § I, adopted March 7, 2017, repealed the former Chapter 15.22, §§ 15.22.010—15.22.120, and § II of Ord. No. 489 enacted a new Chapter 15.22 as set out herein. The former Chapter 15.22 pertained to similar subject matter and derived from Ord. No. 448, adopted March 15, 2011.
15.22.010 - California Fire Code—Adopted by reference.¶
The 2016 edition of the California Fire Code, Title 24, Part 9, including Tables and Appendices, as amended, based upon the 2015 edition of the International Fire Code as published by the International Code Council (ICC), and as adopted by the California Building Standards Commission and codified in Title 24, Part 9 of the California Code of Regulations, and all future amendments thereto are hereby adopted in the City of Ione, except as to amendments and additions contained in this chapter. A copy of this code is available for use and examination by the public at the Office of the Clerk of the City of Ione.

15.22.020 - Findings.¶
The city council hereby finds and determines that amendments to the 2016 California Fire Code to provide modified standards for fire protection is necessary to serve the public interest by reducing the risk to life and property of the citizens of the City of Ione for the following reasons:
A. The City of Ione is located in the Sierra foothills in a high fire risk zone and frequently experiences dry summers with little to no precipitation and temperatures reaching into the 90s. These climatic conditions contribute to the rapid spread of fires.
B. The topography of the City of Ione includes several physical features that impede traffic flows and create congestion. These features include waterways, drainage areas, bridges, railroad tracks, highways, open space, and natural parkways. These physical features and the resulting traffic congestion cause delay in emergency response times.
C. Based on these climatic and topographical conditions, it is necessary to require additional fire protection measures under certain circumstances to mitigate potential fire damages.

15.22.030 - Title.¶
Section 101.1 of the California Fire Code is amended to read as follows: Insert "the City of Ione" in lieu of "Name of Jurisdiction."

15.22.040 - Violation penalties.¶
Section 109.4 of the California Fire Code is amended to read as follows: Inset "misdemeanor" in lieu of "specify offense," insert "one thousand" in lieu of "amount," and insert "six months" in lieu of "number of days."

15.22.050 - Failure to comply.¶
Section 111.4 is amended to read as follows:
Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable for a violation penalty as prescribed by Section 109.4. Each day that this violation continues after a stop work order has been issued shall be deemed a separate offense.

15.22.060 - Fire hydrant systems.¶
Section 507.5.1 of the California Fire Code is hereby amended to read as follows:
WHERE REQUIRED. Where a portion of the facility or building hereafter constructed or moved into or within the City of Ione is more than 150 feet from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains shall be provided as required by the Fire Chief.

15.22.070 - Automatic fire sprinkler systems.¶
Section 903.2 of the California Fire Code is hereby amended to add as follows:
For Group A1, A3, A4, E, F1 not containing woodworking operations, M, S1, and S2 occupancies, an automatic fire sprinkler system, approved by the Fire Chief, shall be installed where the fire area exceeds 5,000 square feet, exclusive of fire wall separations as defined in Section 706 of the California Building Code, Part 2, Volume 1, 2016 edition.
EXCEPTIONS: For Group A1, A3, A4, E, F1 not containing woodworking operations, M, S1, and S2 occupancies, the Fire Chief may waive this requirement, if not required by other provisions of the 2016 California Fire Code, if the building is divided into areas of 5,000 square feet or less by the construction of one or more fire walls that meet the requirements of Chapter 7, Section 706, of the California Building Code, Part 2, Volume 1, 2016 edition. If the integrity of the fire wall(s) is not maintained as specified in the California Building Code, 2016 edition, the building shall be equipped with an automatic fire sprinkler system approved by the Fire Chief.
WHERE REQUIRED: EXISTING STRUCTURES. In addition to any requirements specified in the 2016 California Fire Code for existing buildings, an automatic fire sprinkler system, approved by the Fire Chief, shall be installed in any existing structure when there is a change of character of the occupancy or use of any building which may increase or may cause to increase the hazard of fire or threat to life and safety, as determined by the Fire Chief.

15.22.080 - Locations where above ground tanks are prohibited.¶
Section 5704.2.9.6.1 is amended to specify "within the City limits of Ione" as to the geographic limits.

15.22.120 - Enforcement.¶
The California Fire Code herein adopted shall be enforced by the fire chief.
