Editor's note— Ord. No. 508, § I, adopted December 3, 2019, repealed the former Chapter 15.08, §§ 15.08.010—15.08.080, and § II of Ord. No. 508 enacted a new Chapter 15.08 as set out herein. The former Chapter 15.08 pertained to similar subject matter and derived from Ord. No. 482, adopted March 7, 2017.
15.08.010 - California Residential Building Code—Adopted by reference.¶
The 2019 edition of the California Residential Building Code, Title 24, Part 2.5, including tables and Appendix H, Q, S, V, and X as amended herein, based on the 2018 International Residential Code, as adopted by the California Building Standards Commission in Title 24, Part 2.5 of the California Code of Regulations, and all future amendments thereto, are hereby adopted in the City of Ione. A copy of this code is available for use and examination by the public at the Office of the Clerk of the City of Ione.

15.08.020 - Findings.¶
The city council hereby finds and determines that amendments to the 2019 California Residential Building Code to provide modified standards for fire protection is necessary to serve the public interest by reducing the risk to life and property of the citizens of the City of Ione for the following reasons:
A. The City of Ione is located in the Sierra foothills in a high fire risk zone and frequently experiences dry summers with little to no precipitation and temperatures reaching in to the 90s. These climatic conditions contribute to the rapid spread of fires.
B. The topography of the City of Ione includes several physical features that impede traffic flows and create congestion. These features include waterways, drainage areas, bridges, railroad tracks, highways, open space, and natural parkways. These physical features and the resulting traffic congestion cause delay in emergency response times.
C. Based on these climatic and topographical conditions, it is necessary to require additional fire protection measures under certain circumstances to mitigate potential fire damages.

15.08.030 - Work exempt from permit building: (Exception 1).¶
Section R105.2, Building: (Exception 1) is added to read as follows:
One-story detached accessory structures used as tool and sheds, playhouses and similar uses provided the floor area does not exceed 120 square feet that contain plumbing, mechanical, or electrical installations are not exempt from the permit requirements.

15.08.031 - Work exempt from permit building: (Exception 5).¶
Section R105.2 Building: (Exception 5) is hereby amended to read as follows:
Sidewalks and Driveways provided they are not part of an accessible path of travel required by the City of Ione.

15.08.032 - Work exempt from permit.¶
Section R105.2 is hereby amended to read as follows:
Any work that is exempt from a building permit shall remain subject to other applicable City ordinances, resolutions, rules and regulations, including, but not limited to, the City's Zoning Code and design review requirements.

15.08.033 - Expiration.¶
Section R105.5, expiration is amended to read as follows:
Every Grading, Building, Fire, Plumbing, Mechanical, and Electrical permit issued by the city under this code shall expire by limitation and become null and void two (2) years after the date of issuance (The maximum allowable length for all permits is two (2) years, unless otherwise noted. Extensions will not normally be considered. Applicants with extenuating circumstances may submit written request and a filing fee to the Building Official. Such requests are required to outline extenuating circumstances that did not allow for the completion of the work as permitted) or if the building or work authorized by such permit is not commenced within 180 days from the date of issuance, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced.
Suspension and/or abandonment shall be determined by a lack of progress inspections for a period of more than 180 days since a previous documented inspection. If a permit has expired, no work can recommence until a new permit is obtained.
R105.5.1 (added):
The cost of a new permit, the purpose of which is to facilitate completion of work for which a permit has expired, will be based on a quantitative estimation of inspections deemed necessary for completion. If costs for providing services to the project exceed the estimated fees collected at permit issuance, additional fees will apply. Said fees will be in accordance with the City's Building Division Fee Schedule established by resolution of the City Council. It is the responsibility of the permittee to schedule all inspections necessary for a permit to remain current and valid. All inspections for this purpose must verify progress.
R105.5.2 (added):
Permits may be issued for a limited period of time when deemed necessary by the Building Official to abate dangerous, substandard, and/or illegal conditions. In such cases, the Building Official will establish the expiration at 30, 60, 90, or 180 days depending on the health and/or safety hazards. Such permit term limitations may be shorter if deemed appropriate and/or necessary by the Building Official.

15.08.040 - Section R108.2, schedule of permit fees.¶
Section R108.2, schedule of permit fees of the 2019 California Residential Building Code are hereby amended to read as follows:

All permit fees to include Building, Fire, Electrical, Mechanical, Plumbing, and Grading, shall be in accordance with the schedule of fees adopted by resolution of the City Council from time to time. When a plan or other data are required to be submitted, a plan review fee shall be paid at the time of submitting plans and specifications for review. Plan review fees will be in addition to building permit fees for building, electrical, mechanical, plumbing, and grading work and shall be established by the City's Building Department Fee Schedule established by resolution of the City Council from time to time. Where plans are incomplete or changed so as to require additional plan review, an additional plan review fee shall be charged in accordance with the fee schedule established by the City Council.
Section R108.2.1 "Reinspections" is hereby added to read as follows:
A reinspection fee will be assessed when more than two (2) inspections (1 initial and 1 reinspection) are required due to work for which inspections are requested not being complete or ready for inspection. Additional and subsequent reinspection fees will also be assessed for each inspection thereafter, related to the same work, until compliance has been achieved. To obtain a reinspection the applicant shall first pay the reinspection fee(s) which are established by resolution of the City Council from time to time. When reinspection fees have been assessed, no additional inspection of the work will be performed until the required fee(s) have been paid.

15.08.045 - Work commencing before permit issuance.¶
Section R108.6, work commencing before permit issuance is amended to read as follows: Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to an additional investigation fee as set forth by the city council from time to time. An investigation fee shall be in addition to required permit and plan review fees. An investigation fee shall be collected whether or not a permit is subsequently issued. Payment of investigation fees shall not exempt any person from compliance with all other provisions of this code, or any other city, state, or federal codes, statutes, and ordinances, or from any penalty prescribed by law.

15.08.047 - Pathways.¶
Section R324.6.1, is hereby added to read as follows:
A pathway, not less than 36" wide setback from lowest roof edge of a roof plane with a photovoltaic array, will be required.

15.08.050 - Foundation and retaining walls.¶
Section R404.1.1 is added to read as follows:
Concrete and masonry foundation walls and retaining walls with a height in excess of four (4) feet measured from the bottom of the footing shall have construction documents designed, stamped, and sealed by a California licensed architect or registered engineer (design professional), and said construction documents submitted to the Building Department for review and approval prior to construction. Where applicable, all other design parameters in this chapter apply.

15.08.060 - Roof covering materials.¶
Section R902.1 of the California Building Code is hereby amended to read as follows:
ROOF COVERINGS. Roof assemblies and Roof Coverings on all new construction shall be listed Class A per Section 1505.2 of the California Building Code, metal, or other non-combustible material, and shall be installed over solid sheathing unless the building inspector has approved an alternative engineered structure. Class A roof assemblies and roof coverings required to be listed by this section shall be tested in accordance with ASTM E108 or UL 790. All re-roofing shall be required to meet the same standards of this section and must be approved by the building inspector.

15.08.070 - Enforcement.¶
The California Residential Building Code herein adopted shall be enforced by the Building Department of the City of Ione.

15.08.080 - Penalties.¶
In the event that initial administrative remedies in the California Building Standards Code (Title 24) are not successful in achieving compliance, then Article II (Code Enforcement) of Chapter 1.10 of Title 1 of the Ione Municipal Code (IMC), IMC Title 1, Chapter 1.08 (General Penalty), and IMC Title 1, Chapter 1.10 (Administrative Enforcement Provisions), will be followed for enforcement of penalties. The application of a penalty shall not be held to prevent the enforced removal of prohibited conditions.

15.08.085 - Section AV100.2 Appendix V California Swimming Pool Safety Act.¶
Section AV100.2 of Appendix V is amended to add the following:
A barrier complying with, California Swimming Pool Safety Act AV100.3, shall be installed to separate the pool from the general public in addition to the requirements of California Swimming Pool Safety Act AV100.2.
