Editor's note— Ord. No. 507, § I, adopted December 3, 2019, repealed the former Chapter 15.04, §§ 15.04.010—15.04.120, and § II of Ord. No. 507 enacted a new Chapter 15.04 as set out herein. The former Chapter 15.04, pertained to similar subject matter and derived from Ord. No. 481, adopted March 7, 2017.
15.04.010 - California Building Code—Adopted by reference.¶
The 2019 edition of the California Building Code, Title 24, Part 2, including Tables and Appendices C, I, J, L and O, as amended herein, based on the 2018 International Building Code, as published by the California Building Standards Commission and codified in Title 24, Part 2 of the California Code of Regulations, and all future amendments thereto, are hereby adopted by the City of Ione, except as to amendments contained in this chapter. A copy of this code is available for use and examination by the public at the Office of the Clerk of the City of Ione.

15.14.020 - Findings.¶
The city council hereby finds and determines that amendments to the 2019 California Building Code to provide modified standards for fire protection is necessary to serve the public interest by reducing the risk to life and property of the citizens of the City of Ione for the following reasons:
A. The City of Ione is located in the Sierra foothills in a high fire risk zone and frequently experiences dry summers with little to no precipitation and temperatures reaching in to the 90s. These climatic conditions contribute to the rapid spread of fires.
B. The topography of the City of Ione includes several physical features that impede traffic flows and create congestion. These features include waterways, drainage areas, bridges, railroad tracks, highways, open space, and natural parkways. These physical features and the resulting traffic congestion cause delay in emergency response times.
C. Based on these climatic and topographical conditions, it is necessary to require additional fire protection measures under certain circumstances to mitigate potential fire damages.

15.04.030 - Work exempt from permit.¶
Section 105.2 is amended by adding a sentence to read as follows:
Any work that is exempt from a building permit shall remain subject to other applicable city ordinances, resolutions, and regulations, including but not limited to, the city's zoning code and design review requirements.

15.04.035 - Work exempt from permit—Exception 1.¶
Section 105.2 Building: (Exception 1) is added to read as follows:
One story detached accessory structures used as tool sheds, playhouses, and similar uses whose floor area is less than 120 square feet that contain plumbing or electrical installations are not exempt from the permit requirements.

15.04.040 - Amended construction documents.¶
Section 107.4, Amended construction documents is amended to read as follows:
Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in compliance with the approved construction documents shall be resubmitted for approval as an amended set of construction documents and shall pay a new plan review fee as set forth by the City Council.

15.04.050 - Retention of construction documents.¶
Section 107.5, Retention of construction documents is amended to read as follows:
One set of approved construction documents shall be retained by the Building Official for a period of not less than 180 days from date of completion of the permitted work, or as required by state or other applicable City ordinances, resolutions, and regulations.

15.04.060 - Section 1.8.4.2, Fees and 109.2, Schedule of permit fees.¶
Section 1.8.4.2 Fees and Section 109.2 Schedule of permit fees of the California Building Code are hereby amended to read as follows:
1.8.4.2, Fees. Permit fees and plan review fees are set forth by the City Council.
109.2, Schedule of permit fees. Permit fees and plan review fees are set forth by the City Council.

15.04.070 - Work commencing before permit issuance.¶
Section 109.4, Work commencing before permit issuance is amended to read as follows:
Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to an additional investigation fee as set forth by the City Council. An investigation fee shall be in addition to the required permit fee and plan check fee.

15.04.080 - Where required.¶
Section 903.2 is amended to add as follows:
For Groups A1, A3, A4, E, F1 not containing woodworking operations, M, S1, and S2 occupancies, an automatic fire sprinkler system, approved by the Fire Chief, shall be installed where the fire area exceeds 5,000 square feet, exclusive of fire wall separations as defined in Section 706 of the California Building Code, Part 2, Volume 1, 2019 edition.
EXCEPTIONS: For Group A1, A3, A4, E, F1 not containing woodworking operations, M. S1, and S2 occupancies, the Fire Chief may waive this requirement, if not required by other provisions of the 2019 California Fire Code, if the building is divided into areas of 5,000 square feet or less by the construction of one or more fire walls that meet the requirements of Chapter 7, Section 706, of the California Building Code, Part 2, Volume 1, 2019 edition. If the integrity of the fire wall(s) is not maintained as specified in the California Building Code, 2019 edition, the building shall be equipped with an automatic fire sprinkler system approved by the Fire Chief.
WHERE REQUIRED: EXISTING STRUCTURES. In addition to any requirements specified in the 2019 California Fire Code for existing buildings, an automatic fire sprinkler system, approved by the Fire Chief, shall be installed in any existing structure when there is a change of character of the occupancy or use of any building which may increase or may cause to increase the hazard of fire or threat to life and safety, as determined by the Fire Chief.

15.04.090 - General (fire classification of roof assemblies and roof coverings).¶
Section 1505.1 of the California Building Code is hereby amended to read as follows:
ROOF COVERINGS. Roof assemblies and Roof Coverings on all new construction shall be listed Class A per Section 1505.2 of the California Building Code, metal, or other non-combustible material, and shall be installed over solid sheathing unless the building inspector has approved an alternative engineered structure. Class A roof assemblies and roof coverings required to be listed by this section shall be tested in accordance with ASTM E108 or UL 790. All re-roofing shall be required to meet the same standards of this section and must be approved by the Building Official.

15.04.100 - Establishment of flood hazard areas.¶
Section 1612.3 is amended as follows:
"City of Ione California Amador County" is added in place of "Insert Name of Jurisdiction" and "August 3, 1989" is added in place of "Insert Date of Issuance".

15.04.110 - Enforcement.¶
The California Building Code herein adopted shall be enforced by the Building Department of the City of Ione, except such requirements relating to fire and panic safety, and other regulations of the State Fire Marshal as they relate to Group R Occupancies, which shall be enforced by the Fire Chief.

15.04.120 - Penalties.¶
Violation of this chapter is a misdemeanor, punishable by a fine of not more than $1,000.00, or by imprisonment for not more than six months, or both. The imposition of one penalty for any violation shall not excuse the violation or permit to continue. All violations shall be corrected or remedied within a reasonable time and, if not otherwise specified, each ten days that the violation is maintained shall constitute a separate offense. The application of a penalty shall not be held to prevent the enforced removal of prohibited conditions.

15.04.130 - California Swimming Pool Safety Act.¶
Section 3109.2 is amended to add the following:
A barrier complying with, California Swimming Pool Safety Act 115923, shall be installed to separate the pool from the general public in addition to the requirements of California Swimming Pool Safety Act 115922.
