Editor's note— Ord. No. 513, § I, adopted December 3, 2019, repealed the former Chapter 15.20, §§ 15.20.010—15.20.130, and § II of Ord. No. 513 enacted a new Chapter 15.20 as set out herein. The former Chapter 15.20 pertained to similar subject matter and derived from Ord. No. 487, adopted March 7, 2017.
15.20.010 - International Code Council Property Maintenance Code—Adopted by reference.¶
The 2018 edition of the International Code Council Property Maintenance Code, as published by the International Code Council (ICC), and all future amendments thereto, are hereby adopted in the City of Ione. A copy of this code is available for use and examination by the public at the Office of the Clerk of the City of Ione.

15.20.020 - Title.¶
Section 101.1 is amended to read "The City of Ione" in lieu of "Name of Jurisdiction".

15.20.030 - Application of other codes.¶
Section 102.3 is amended to read as follows:
Repairs, addition, or alterations to a structure, or changes in occupancy, shall be done in accordance with the procedures and provisions of the 2019 Title 24 California Building Standards Codes as adopted by the City of Ione. Wherever a reference is made in the 2018 ICC Property Maintenance Code to an International Code, the provisions of the applicable California Building Standards Codes shall apply.

15.20.040 - Fees.¶
Section 103.5 is amended to read as follows:
Subject to other provisions of law, the governing body of any city may prescribe fees to defray the cost of enforcement of rules and regulations promulgated by the Department of Housing and Community Development. The amount of the fees, as set forth by the City Council from time to time, shall not exceed the amount reasonably necessary to administer or process permits, certificates, forms, or other documents, or to defray the cost of enforcement.

15.20.050 - Failure to comply.¶
Section 112.4 is amended to read as follows:
Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to immediately remove a violation or unsafe condition, shall be liable to a fine as determined by the City Council.

15.20.060 - Weeds.¶
Section 302.4 is amended to read "limitations determined by the City of Ione Fire Department" in lieu of "Jurisdiction to insert height in inches."

15.20.070 - Enclosures.¶
Section 303.2 is amended to read as follows:
Enclosures for private swimming pools, hot tubs, and spas shall be maintained as provided in Section 3109 of the 2019 California Building Code. Enclosures for public swimming pools, hot tubs, and spas shall be maintained as provided in Section 3118B of the 2019 California Building Code. No existing pool enclosure shall be removed or changed in a manner that reduces its effectiveness as a safety barrier. Replaced pool enclosures shall be in compliance with the current requirements in the 2019 California Building Code.

15.20.075 - Required enclosures.¶
Section 303.2.1 Required Enclosures added to read as follows:
A barrier complying with CBC Section 3109.2 California Swimming Pool Safety Act 115923, shall be installed to completely separate the pool from the general public in addition to the requirements of California Swimming Pool Safety Act 115922.

15.20.080 - Insect screens.¶
Section 304.14 is amended to read "On a continuous year round basis" in lieu of "During the period from Date to Date."

15.20.090 - Handrails and guardrails.¶
Section 307.1 is deleted in its entirety and replaced to read as follows:
Every existing handrail and guard shall be firmly fastened and capable of supporting normally imposed loads and shall be maintained in good condition. Replacement of existing and installation of new handrails and guards, shall comply with the requirements specified in Sections 1014, 1015, and 1607.8 of the 2019 California Building Code, Part 2 and applicable provisions of the 2019 California Building Code, Part 2, Chapters 11A and 11B.

15.20.100 - Heat supply.¶
Section 602.3 is amended to read "on a continuous year round basis" in lieu of "during the period from Date to Date."

15.20.110 - Occupiable work spaces.¶
Section 602.4 is amended to read "on a continuous year round basis" in lieu of "during the period from Date to Date".

15.20.120 - Enforcement.¶
The International Code Council Property Maintenance Code herein adopted shall be enforced by the Building Department of the City of Ione.

15.20.130 - Penalties.¶
Violation of this chapter is a misdemeanor, punishable by a fine of not more than $1,000.00, or by imprisonment for not more than six months, or by both. The imposition of one penalty for any violation shall not excuse the violation or permit to continue. All violations shall be corrected or remedied within a reasonable time and, if not otherwise specified, each ten days that the violation is maintained shall constitute a separate offense. The application of a penalty shall not be held to prevent the enforced removal of prohibited conditions.
