§ 5-21.201. Statement of purpose.¶
The purpose of this chapter is to establish a comprehensive set of rules and regulations for the use of the public skate park facility in the City of Huntington Park.

§ 5-21.202. Skate park designated.¶
The City of Huntington Park designates and maintains as a skate park facility (hereinafter "skate park") that area located at 3401 East Florence Avenue, Huntington Park, California 90255, for the purpose of riding or using skateboards and in-line skates.

§ 5-21.203. Definitions.¶
For the purpose of carrying out the intent of this chapter, words, phrases and terms used herein shall have their ordinary meaning unless otherwise indicated as follows:
"Department"
means the City of Huntington Park, Parks and Recreation Department.
"Designated skate park"
means an area within a park or other public property which is posted as a skate park permitting one or more skate activities, and which is reserved exclusively, either during all hours of operation, or during posted times, for one or more skate activity.
"Director"
means the Director of Parks and Recreation, or designee.
"In-line skates,"
including roller blades, is defined as any shoe, boot or other footwear to which one or more wheels are attached.
"Public skate park facility"
is defined as any facility, structure or area in which skateboarding, in-line skating is permitted pursuant to the provisions of this chapter, which is owned, operated and maintained by the City, and which has been designated as a "public skate park facility" by ordinance of the City Council.
"Roadway"
means that City portion of the highway or street improved or designed especially for vehicular use or travel.
"Sidewalk"
means that portion of a road, street or highway designed or ordinarily used for pedestrian travel and includes any pedestrian walkways in any parks within the commercial or business districts of the City.
"Skateboard"
is defined as any platform of any composition or size to which two or more wheels are attached and which is intended to be ridden or propelled by one or more persons standing or kneeling upon it and to which there is not affixed any seat or any other devise or mechanism to turn and control the wheels.
"Skater"
means any person participating in a skate activity.
"Skate activity"
means the use of a skateboard, as defined in subsection (e), or the use of in-line skates, as defined in subsection (d).

§ 5-21.204. Required riding equipment in skate park—Regulations.¶
(a) It is unlawful for a person to ride or use a skateboard or in-line skates in the skate park unless that person is wearing a helmet, elbow pads and knee pads.
(1) All such gear must be functional and protective, properly sized and designed for their intended use at the skate park facility.
(2) Every person using the skate park facility who is under the age of 14 must be supervised by an adult.
(b) The Director may set forth any other rules and regulations for the use of a public skate park facility, which he or she deems appropriate provided that signs describing such rules and regulations are placed and posted pursuant to this chapter.

§ 5-21.205. In-line skating permitted.¶
In-line skating shall be permitted in the City's skate park.

§ 5-21.206. Skateboarding and in-line skating are hazardous recreational activities.¶
Skateboarding and in-line skating at the City's skate park represent hazardous recreational activities for participants and the City of Huntington Park will not be liable for injuries incurred by persons engaging in the hazardous recreational activities in the City's skate park.

§ 5-21.207. Use or operation of skateboards and in-line skates prohibited.¶
It is unlawful for any person(s) to use or operate skateboards and in-line skates upon any sidewalk or roadway in the business or commercial areas of the City at the following locations:
(1) City Hall;
(2) Public parks located within the City, unless the director has designated a particular activity or program to take place at a City park;
(3) Florence Avenue;
(4) Gage Avenue;
(5) Slauson Avenue;
(6) Pacific Boulevard;
(7) Santa Fe Avenue;
(8) Alameda Street;
(9) Rugby Avenue;
(10) Seville Avenue;
(11) State Street.

§ 5-21.208. Areas for nonuse of skateboards and in-line skates.¶
The City Council of the City may from time to time review the business and commercial areas within the City boundaries and may declare after such review, areas which may be specifically designated for the nonuse of skateboards or in-line skates. Such declaration may be accomplished by adoption or amendment of existing ordinances or by declaration and passage and adoption of an ordinance or resolution.

§ 5-21.209. Restrictions on operation.¶
No person shall operate or ride a skateboard, in-line skates or similar device upon any sidewalk, street or parking area in any manner which endangers the safety of any other person or property or restricts the movements of pedestrians. Operating or riding a skateboard or similar device within five feet of a pedestrian shall constitute endangerment.

§ 5-21.210. Miscellaneous regulations.¶
With respect to the City's skate park facility, it is unlawful for any person to do any of the acts hereinafter specified:
(a) To place or utilize obstacles or other materials within the skate park that are not affixed that to the skate park by the City for recreational purposes.
(b) To enter the skate park for purposes other than skateboarding, in-line skating or assisting a skateboarder or inline skater.
(c) To use the skate park while under the influence of alcohol or drugs that would impair the person's judgment or motor skills. To possess any can, bottle or other receptacle containing any alcoholic beverage (as the term "alcoholic beverage" is defined by the Alcoholic Beverage Control Act in the Statutes of 1935, 330, of the State, or any act amendatory thereof) which has been opened, has a seal broken, or the contents of which have been partially removed.
(d) To ride or use any in-line skates or skateboards at the public skate park facility in a reckless manner or with willful disregard for the safety of persons or property or to cause such items to be ridden or used in such manner. Engage in reckless or boisterous behavior or any other activity that could endanger the safety of other persons using the skate park. Stunts, tricks and luge skateboarding by person under 14 years of age shall be deemed to be reckless operation.
(e) To ride, operate, or utilize any device other than a skateboard or in-line skates, including, but not limited to, bicycles, unicycles, scooters, go-carts and wagons on the skating surface of the public skate park facility, or to cause such items to be ridden or used on the skating surface of the public skate park facility.
(f) To allow or cause graffiti or tagging in, on or around any part of the skate park facility.
(g) To deposit or leave garbage cans, bottles, papers, waste or refuse of any kind in a location other than a receptacle provided for such purpose, or to cause such items to be deposited or left in such a manner. If no receptacle is provided, each person shall be responsible for removing and disposing of such items in an appropriate manner.
(h) To allow or cause any animal of any kind to be brought into the public skate park facility.
(i) To allow or cause glass containers of any kind to be brought into the public skate park facility and to use glass containers within the skate park.
(j) No organized activity, event or competition shall take place in any designated skate park without the written permission of the Director.
(k) No portion of any designated skate park may be modified, altered, or added to in any manner without the written permission of the Director.
(l) Skate activities are limited within the designated skate park to surfaces, equipment or obstacles installed for that purpose. No skate activity is permitted on walls or other boundary structures or seating areas immediately surrounding or adjoining the designated skate park.
(m) The Director is authorized to post additional rules that she or he determines are necessary for the safe operation of the designated skate park.

§ 5-21.211. Occupying public skate park during certain hours prohibited.¶
Every person who occupies, or is present in, the public skate park within the City between the hours of 10:00 p.m. and 6:00 a.m. without a permit therefor, is guilty of a misdemeanor.

§ 5-21.212. Hours of operation.¶
The public skate park facility shall be open from 6:00 a.m. to 10:00 p.m. daily and or as otherwise posted by the Director.

§ 5-21.213. Liability.¶
The use of the public skate park facility shall be deemed a hazardous recreational facility within the meaning of Section 831.7 of the Government Code. The City of Huntington Park may not be held liable for the injuries incurred by persons who participate in any such hazardous recreational activity.

§ 5-21.214. Posting signs at skate park.¶
In order to provide reasonable notice to the public, the Director shall place and post signs in one or more conspicuous and visible area(s) of the skate park facility designating the facility, structure or area as the public skate park facility, specifying the rules and regulations established pursuant to this chapter, and prohibiting the activities described in this chapter. The signs required pursuant to this section shall cite the respective Huntington Park Municipal Code being invoked.

§ 5-21.215. Enforcement.¶
The Director or designee shall have the authority to eject and expel from the public skate park facility any person who is in violation of this chapter or any other park rules and regulations. Any person failing to comply with the provisions of this chapter shall be subject to citation, removal or other applicable enforcement authority available to the City. Criminal violations of this chapter shall be punishable as infractions.

§ 5-21.216. Violation: Penalty.¶
Violation of any provision of this chapter is declared to be an infraction in the amount of $50.
