§ 5-1.01. Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

"Handbill"

includes any printed or written advertising matter, any sample or device, dodger, circular, leaflet, pamphlet, newspaper, paper, booklet or any other printed matter or literature.

§ 5-1.02. Throwing handbills on public property.

No person, either directly or indirectly, shall deposit, place, throw, scatter, or cast any handbill in or on any public place within the City; the provisions of this section shall not be deemed to prohibit the handing of any handbill to any person willing to accept such handbill.

§ 5-1.02.1. Distributing handbills in the downtown area.

No person shall distribute or hand out any commercial handbill in or on any public street, sidewalk, right-of-way or place, or on any private property without the express permission of the owner thereof, in the area bounded by the northern boundary of the Slauson Avenue right-of-way on the north, the center-line of Florence Avenue on the south, the western boundary of the Malabar Street right-of-way on the west, and the eastern boundary of the Seville Street right-of-way on the east.

§ 5-1.02.2. Business identification on handbills.

No person shall distribute or hand out any commercial handbill which does not contain on its face the name and address of the business on whose behalf the handbill is being distributed.

§ 5-1.03. Putting handbills in or on vehicles.

(a) No person, either directly or indirectly, shall distribute, deposit, place, throw, scatter or cast any handbill in or upon any automobile or other vehicle.

(b) No person or entity directing, controlling, employing or hiring persons to distribute handbills shall permit, allow or fail to exercise reasonable precautions to prevent any of the acts prohibited by Subsection (a) above.

(c) The provisions of this section shall not be deemed to prohibit the handing of any handbill to the owner or other occupant of any automobile or other vehicle, provided such recipient is willing to accept such handbill.

§ 5-1.04. Distributing handbills to private property.

No person shall distribute any handbill to the owner or occupant of a private property who has expressed his or her objection to such distribution, either orally, by the posting of a sign or other notice in a conspicuous place indicating that no handbills are desired, or by writing or telephoning the handbill distributor to indicate that no handbills are desired.

§ 5-1.05. Exceptions regarding distribution to private property.

The provisions of this chapter shall not apply to the distribution of the United States mail. In making delivery of any handbill to any person or property, including private properties as to which the owner or occupant has not expressed his or her objection to such distribution, the handbill shall either be delivered personally to the person or placed upon the premises in such a manner that the handbill will not be blown from the premises of such person onto the private property of other persons, or the streets, or public places within the City.

§ 5-1.06. Violation and penalty.

(a) Violation of this chapter is a misdemeanor and is punishable by a fine of not more than $500.

(b) Any handbills distributed on public property in violation of Section 5-1.02 may be removed by any duly authorized employee of the City. In the event that such handbills are removed by an employee of the City, the person responsible for distributing such handbills and/or the person or entity directing, controlling, employing or hiring the handbill distributor shall be liable to the City for the cost of cleaning up such handbills in addition to any other penalties provided by law.
