§ 5-28.01. Findings.

The Council hereby finds that the parking of vehicles on public or private property within the City without the consent or authorization of the owner or lawful occupant of such property constitutes a public nuisance.

§ 5-28.02. Parking of vehicles prohibited.

No person shall park a vehicle on public or private property within the City, unless the consent or authorization of the owner or lawful occupant is first obtained.

§ 5-28.03. Citations to operators of vehicles and removal of vehicles.

Upon the written request of the owner or lawful occupant of the real property where a vehicle has been parked without the consent or authorization of the owner or lawful occupant, the Police Chief, or any police officer acting under his or her authority, may cite the operator of such vehicle and shall cause the vehicle to be removed by the person or firm with whom the City contracts for towing and storage services. Such vehicle, when impounded and towed to such storage facility, shall not be released until the towing and storage fees are paid by, or on behalf of, such vehicle operator who parked the vehicle on such property.

§ 5-28.04. Violations—Penalties.

Any person who violates this chapter shall be guilty of a misdemeanor. Any person convicted of a misdemeanor shall be punishable by a fine of not more than $500, or by imprisonment in the City Jail or County Jail for a period not exceeding six months, or by both such fine and imprisonment.
