Fullerton Municipal Code Ch. 8.80 Regulation of Vehicles Containing “for Sale” Signs, Markings or Placards

(A) It shall be unlawful for any person to park any vehicle on the streets or public lands in the city listed in this section for the purpose of advertising to the public the private sale of that vehicle.

(B) City streets or public lands where vehicle sales are prohibited: on frontage roads adjacent to Orangethorpe Avenue.

(A) Pursuant to Cal. Vehicle Code § 22651.9, the city authorizes any peace officer, or any regularly employed and salaried employee, who is engaged in enforcing parking laws and regulations of the city, to remove a vehicle located within the city limits which is in violation of this chapter, if all of the following requirements are satisfied:

(1) Because of a sign, marking or placard on the vehicle, it appears that the primary purpose of parking the vehicle at that location is to advertise to the public the private sale of that vehicle;

(2) Within the past 30 days, the vehicle is known to have been previously issued a notice of parking violation pursuant to this chapter, which was accompanied by a notice containing all of the following:

(a) A warning that an additional parking violation may result in the impoundment of the vehicle;

(b) A warning that the vehicle may be impounded pursuant to this chapter and Cal. Vehicle Code § 22651.9, even if moved to another street, so long as the signs, markings or placards offering the vehicle for sale remain on the vehicle; and

(c) A listing of the streets or public lands subject to this chapter.

(3) The notice of parking violation was issued at least 24 hours prior to the removal of the vehicle.

(B) Cal. Vehicle Code § 22852 shall apply to the removal of any vehicle pursuant to this section.

Any violation of this chapter shall be subject to the provisions of Chapters 1.08 (Penalty Provisions) and 1.10 (Administrative Citations) of this code.
