Fullerton Municipal Code Ch. 8.76 Cost Recovery for Vehicle Removal

§ 8.76.010 PURPOSE.

The provisions of this chapter are adopted in accordance with the determination made and the authority granted by the state under Cal. Vehicle Code § 22850.5 to allow for the imposition of a charge equal to the city’s administrative costs relating to the removal, impound, storage or release of properly impounded vehicles in connection with the city’s enforcement of the provisions contained in Cal. Vehicle Code § 14602.6.

§ 8.76.020 SCOPE.

The provisions of this chapter shall only apply to the registered owner or the agents of that registered owner and shall not include the following:

(A) Any vehicle towed pursuant to the abatement provisions contained in Chapters 5.20 and 6.01 of this code; or

(B) Any vehicle sold at a lien sale pursuant to Cal. Civil Code §§ 3068.1 through 3074, inclusive, and Cal. Vehicle Code § 22851 unless the sale proceeds are sufficient to pay both the lienholder’s total charges and the city’s administrative costs.

§ 8.76.030 ADMINISTRATIVE COSTS.

The City Council shall from time-to-time determine and fix an amount to be assessed as administrative costs under this chapter, which amount shall be set by City Council resolution at a fixed rate per vehicle in connection with the city’s enforcement of the provisions contained in Cal. Vehicle Code § 14602.6. Said administrative costs shall be collected by the city from the registered owner or the agents of that registered owner at the time of release.

§ 8.76.040 WAIVER OF ADMINISTRATIVE COSTS.

Upon request by the registered owner of the vehicle or the agents of that registered owner, the Chief of Police may grant a waiver of the administrative costs under this chapter where verifiable proof is presented to show that the vehicle in question was reported stolen at the time the vehicle was removed.
