2.14.010 - Adoption.

In order to establish an equitable and uniform procedure for dealing with personnel matters, to attract to municipal service the best and most competent persons available, to assure that appointments and promotions of employees will be based on merit and fitness, and to provide a reasonable degree of security for qualified employees, the system set out in this chapter is adopted.

2.14.020 - Personnel officer.

The personnel officer shall:

A. Be the city manager;

B. Prepare and recommend to the council as required, revisions and amendments of the city's personnel rules. All personnel rules or modifications to the personnel rules shall be adopted by resolution;

C. Prepare a position classification and compensation plan, including class specifications and revisions of the plan as required. The plan and any revisions thereof shall become effective upon the adoption of a resolution by the council.

2.14.030 - Exempt service.

The provisions of this chapter, the position classification and compensation resolution and personnel rules shall apply to all offices, employees and positions in the city service except the following:

A. City attorney;

B. City manager;

C. Elective offices;

D. Limited service (part-time) personnel;

E. Members of appointive boards, commissions and committees;

F. Persons engaged under contract to supply expert, professional or technical services for a definite period of time;

G. Volunteer personnel who receive no regular compensation from the city.

2.14.040 - Appointing authority.

The appointing authority shall be the city council in the case of appointments to the position of city manager and city attorney and shall be the city manager in all other cases.

2.14.050 - Creation and abolishment of positions.

The council shall have authority to create and/or abolish positions in the city service. The incumbents of an abolished position may be laid off, transferred or demoted as provided in the personnel rules.

2.14.060 - Political activity prohibited.

Employees in the service of the city shall not:

A. Advocate the election or defeat of any ballot proposition or any candidate for any political office or engage in any other kind of political activity during his assigned working hours or while dressed in the uniform required in any department of the city whether or not it is during his assigned working hours.

B. Violate the provisions of the Hatch Act which apply to those employees whose principle employment duties are in connection with an activity which is financed in whole or in part by loans or grants made by the United States or a federal agency.

2.14.070 - Solicitation of contributions for political purposes.

No officer or employee of the city, directly or indirectly, shall solicit or receive, or in any manner be concerned in soliciting or receiving any assessment, subscription, contribution or political service, for aiding or assisting in the campaign for election or appointment to any political or official or other positions in the city government, either partisan or nonpartisan.
