Sec. 2-110. - Office created.

The office of the city attorney of the City of El Centro is hereby created.

Sec. 2-111. - Qualifications.

The city attorney shall be an attorney-at-law, licensed to practice law in the state.

Sec. 2-112. - Appointment; tenure.

The council shall appoint a city attorney, who shall hold office during the pleasure of the council.

Sec. 2-114. - Compensation.

The city attorney shall receive such compensation as the council shall determine.

Sec. 2-115. - Duties generally.

The city attorney shall have the following prescribed duties:

(1) Advise the city officials in all legal matters pertaining to city business.

(2) Frame all ordinances and resolutions required by the council.

(3) Perform other legal services required from time to time by the council.

(4) Keep the city council informed of the status of all litigation involving the city and its agencies.

(5) Act as legal counsel for all city agencies described in this City Code.

(6) Notwithstanding subsection (5) above, the city attorney may retain legal counsel to represent city agencies described in this city code. The city attorney shall review and make recommendations upon all invoices and/or billings for counsel services prior to payment thereon.

Sec. 2-116. - To manage, control office.

The city attorney shall have the management and control over his office.

Sec. 2-117. - Employment of special legal counsel.

The city council or applicable city agency governing body may, from time to time, retain special legal counsel to associate with the city attorney in any matter customarily requiring or warranting the need of such special legal counsel by reason of their expertise in particular matters, upon recommendation of the city attorney and approval and authorization thereof by the city council or appropriate city agency governing body. The city attorney shall review and make recommendation upon all invoices and/or billings for special counsel services prior to payment thereon.
