Sec. 15-1. - Establishment; adoption of state law.

(a) A public library is hereby established in and for the city in accordance with the provisions of Chapter 5 of Part II of Division I of Title I of the California Education Code commencing with section 18900.

(b) Sections 18900 through 18965 of the Education Code of the state are hereby adopted as a part of this chapter for creation, maintenance and government of such public library, together with all amendments thereto which may hereafter be adopted by the legislature of the state.

Sec. 15-2. - Board of library trustees; library director.

(a) The public library established as provided in section 15-1 shall be managed by a board of library trustees consisting of five (5) members to be appointed by the mayor in accordance with sections 18910 to 18927 of the Education Code of the state.

(b) The city manager shall appoint a library director upon consultation with the library board. The library director will report to both the library board and the city manager. The library director's performance will be reviewed annually by the city manager in consultation with the library board.

(c) "City librarian" shall also mean library director.

Sec. 15-3. - Incurring indebtedness in excess of revenue.

Neither the city nor the board of library trustees shall incur any indebtedness nor become liable for any indebtedness in excess of the revenue which may be provided for maintenance of the public library; provided, however, that this shall not be understood as prohibiting the acceptance and use of money by gift, devise, bequest or otherwise.
