10.31.010 - Purpose and intent.¶
The city council finds and declares that the provisions of this chapter are enacted for the following reasons:
A. There are privately owned and maintained off-street parking facilities located within the city which are generally held open for use of the public for purposes of vehicular parking; and
B. It is the desire of the city to provide designated parking spaces for the use of physically handicapped persons both in public and designated private off-street parking facilities; and
C. The city finds that the public health, safety, and welfare require that certain provisions of the Vehicle Code be uniformly and efficiently enforced on privately owned and maintained off-street parking facilities located within the city which are generally held open for the use of the public for purposes of vehicular parking; and
D. Section 21107.8 of the Vehicle Code authorizes the city to adopt an ordinance whereby privately owned and maintained off-street parking facilities located within the city which are generally held open for use of the public for purposes of vehicular parking may be subject to certain provisions of the Vehicle Code; and
E. The city finds and determines the following privately owned and maintained off-street parking facilities are generally held open for use of the public for purposes of vehicular parking and thereby are subject to enforcement of the Vehicle Code including handicapped and fire lane parking restrictions, which locations include, but are not limited to:
Stater Brothers, Riverside Drive/Yorba Avenue,
Chino Valley Farms, Riverside Drive/Oaks Avenue,
Mountain Village Plaza, Riverside Drive/ Mountain Avenue,
Von's Shopping Center, Walnut Avenue/ Central Avenue,
Walnut Business Park, Walnut Avenue/ Central Avenue,
El Centro Real Plaza, Central Avenue/Mt. Vernon Avenue,
Alpha Beta Center, Philadelphia Avenue/ Central Avenue,
Country Fair Center, Philadelphia Avenue/ Central Avenue,
Chino Town Center, Philadelphia Avenue/ Central Avenue,
Ramona Village, Ramona Avenue/Philadelphia Avenue,
Mountain 60 Center, Mountain Avenue/ Pomona Freeway,
Chino Hills Plaza, Pipeline Avenue/ Eucalyptus Avenue,
Chino Town Square, Philadelphia Avenue/ Benson Avenue,
Pic 'N Save Center, Walnut Avenue/Central Avenue,
Chino Village Shopping Center, Pipeline Avenue/Riverside Drive,
Plaza del Chino, Riverside Drive/Benson Avenue,
Central Court, Philadelphia Avenue/Central Avenue,
Shopping Center at Riverside Drive and Yorba Avenue,
Shopping Center at Central Avenue and Francis Avenue,
Majestic Properties including Hussman Corporation at southwest corner of Ramona and Schaefer Avenues (Resolution 91-11).
F. After the effective date of the ordinance codified in this section, the locations described in Subsection E of this section may be deleted or added to by resolution.

10.31.020 - Public hearing.¶
The city council shall conduct a public hearing pursuant to Vehicle Code Section 21107.8, not less than ten days after giving notice of such hearing, as required by law, to all interested owners and operators of privately owned and maintained off-street parking facilities.

10.31.030 - Enforcement of Vehicle Code.¶
A. The parking areas designated in this chapter are subject to the enforcement of the following Vehicle Code sections:
22350 CVC, Basic Speed Law; Driving;
23103 CVC, Reckless Driving;
23109 CVC, Exhibition of Speed;
Division 16.5 of the California Vehicle Code, commencing with Section 38000.
B. Notwithstanding the provisions of subsection A of this section, this section shall not apply to any such off-street parking facility as is described in subsection A unless the owner or operator of such off-street parking facility has caused to be posted in a conspicuous place at each entrance to such off-street parking facility a notice of not less than seventeen by twenty-two inches in size with lettering not less than one inch in height, to the effect that such off-street parking facility is subject to public traffic regulations and control.

10.31.040 - Posting of signs.¶
A. City staff shall work with the owners and operators of the parking facilities described in subsection E of Section 10.31.010, to secure the posting of signs in accordance with Vehicle Code Section 21107.8(a), indicating that said lots are subject to public traffic regulations and control.
B. To maintain continuity, owners and operators may order signs through the city from authorized vendors.
C. That handicapped spaces shall be designated for the exclusive use of vehicles which display a distinguishing license plate or placard. Each space shall be designed by posting immediately adjacent to, and visible from the parking space, a sign consisting of a profile view of wheelchair with occupant in white on a blue background, and by either outlining the space in blue and outlining on the ground in the space in which and a contrasting color a profile of the wheelchair with occupant, or a profile view of a wheelchair with occupant in white with a blue background on the ground, pursuant to 22522.8 of the Vehicle Code.

10.31.050 - Handicapped parking.¶
The city council may designate, by resolution, parking stalls or spaces in any off-street parking facility, whether privately or publicly owned, for the exclusive use of any vehicle which displays either a distinguishing license plate or placard issued pursuant to Vehicle Code Section 22511.5 or 22511.9. The designation of such parking stalls or spaces shall be made pursuant to Vehicle Code Section 22511.7 or 22511.8.

10.31.060 - Violation—Penalty.¶
A. Vehicle operators who are found in violation of this chapter shall be subject to the provisions of the Vehicle Code.
B. Owners/operators of designated off-street parking lots described in Section 10.31.010, are subject to the provisions of this chapter and any violation of the provisions of this chapter shall constitute an infraction; and upon conviction thereof, shall be punishable as provided in Section 10.12.010.
C. An owner/operator shall be subject to enforcement for failure to comply and each separate offense shall be considered a separate violation of this chapter.
