10.24.010 - Legislative purpose.¶
The city council finds and declares that the provisions of this chapter are enacted for the following reasons:
A. Skateboarding, roller-skating, and in-line or roller-blading are a common practice by persons upon the public right of ways, public grounds and commercial areas within the city.
B. Skateboarding and roller-skating (which includes in-line and roller-blading) on the public rights of way within the city creates the potential for property damage to public facilities and traffic accidents among the persons traveling in the public rights of way.
C. Skateboarding and roller skating (which includes in-line and roller-blading) on public grounds and commercial areas within the city creates the potential for persons using skateboards or skates to run into members of the public and customers, thereby causing peril to themselves and members of the public.
D. The public health, safety and welfare require that individuals operating skateboards or roller skates (which includes in-line and roller-blades) upon the public rights of way within the city follow general regulations to reduce hazardous conditions resulting from skateboarding or roller skating on the public rights of way, public grounds and commercial areas within the city.
E. It is the purpose of this chapter to establish regulations for the safe use of designated skateboard/skating areas within the city of Chino.

10.24.020 - Definitions.¶
For purposes of this chapter, the following definitions shall apply:
A. "Commercial area" means the public right of way within the city's commercial zones where one or more commercial establishments are located.
B. "Public ground" means all areas devoted to public use in the city, including, but not limited to, public schools, city parks, recreation centers, civic centers, public libraries, public auditoriums, fairgrounds, airports, museums, public parking lots, and open spaces adjacent thereto.
C. "Roller skates" means any shoe, boot, or other footwear to which one or more wheels are attached, and shall include in-line skates and roller blades.
D. "Scooter" means a non-motorized device with at least one wheel, a mechanism for controlling the wheels, and no seat.
E. "Skateboard" means any platform of any composition, that is forty inches in length or less, to which are attached two or more wheels four inches or less in diameter, and which is intended to be ridden or propelled by one person standing or kneeling upon it, and to which no seat is affixed, and on which there is no device or mechanism to turn or control the wheels.
F. "Skateboard/skating area" means a "public skateboard park" as that term is used in California Health and Safety Code Section 115800(d)(1), or any successor provisions thereto, and includes any facility, structure, or area designated by resolution of the city council as a "skateboard/skating area" in which the use of skateboards, roller skates, scooters, and wheelchairs is permitted pursuant to the provisions of this chapter.
G. "Wheelchair" means a chair on wheels that people who are unable to walk use for moving around.
H. "Wheeled recreational device" means skateboards, roller skates, scooters, and wheelchairs.

10.24.030 - Yield of right of way.¶
Any person riding or propelling a skateboard or wearing roller skates or other similar wheeled devices attached to his/her feet, shall yield the right of way to all pedestrians, motor vehicles, persons in wheelchairs and animals.

10.24.040 - Operation upon public grounds prohibited.¶
It shall be unlawful for any person, while riding upon or propelling any skateboard, as defined herein, or while wearing roller skates, as defined herein, to go upon any public ground, public parking lot, or public structure if there is displayed in plain view on the property, a sign or signs prohibiting such riding as provided by Section 10.24.050(B).

10.24.050 - Riding on private property.¶
A. It shall be unlawful for any person riding upon or propelling any skateboard, as defined herein, or wearing roller skates, as defined herein, to travel upon any private sidewalk, private driveway, private parking lot, or private parking facility within any commercial area within the city without the written consent of the owner or person in lawful possession of the property, if there is displayed, in plain view on the property a sign or signs prohibiting such riding as provided in subsection (B) herein.
B. The owner or person in lawful possession of the property may display signs in plain view, preferably at the property entrance or entrances, prohibiting the activity in subsection (A) herein. The signs must be a minimum of seventeen inches by twenty-two inches with one inch block lettering on a contrasting background. The text of the sign must include the following information:
"NO SKATEBOARDING OR ROLLER SKATING ALLOWED. VIOLATORS WILL BE CITED. SECTION 10.24.120 CMC. CHINO POLICE DEPARTMENT. 628-1234."
C. Either of the activities prohibited in subsection (A) above may be deleted from the signs if that activity is acceptable to the property owner or person in lawful possession of the property.
D. Any activity not prohibited by any posted sign as described in Section (B) herein, shall be permitted.

10.24.060 - Use of incline devices prohibited.¶
No person shall construct, establish, maintain, use or place a portable railing system, a ramp, or other incline device, to be used for skateboarding, or roller skating, upon any public ground, commercial area, street, highway, lane, alley or sidewalk within the city.

10.24.070 - Liability.¶
The use of any skateboard/skating area is a hazardous recreational activity within the meaning of California Government Code Section 831.7. Subject to the provisions of that code section, the city of Chino may not be held liable for an injury incurred by any person participating in any such hazardous recreational activity. Skateboarding/skating areas are not regularly supervised and all users assume risks of injury in utilizing said areas.

10.24.080 - Regulations applicable to the use of skateboard/skating areas.¶
A. No person shall be present within any skateboard/skating area at times other than those established as the hours of operation. Hours of operation shall be posted. Said hours are subject to change without prior notice.
B. No person shall use any skateboard/skating area for any activity other than the use of wheeled recreational devices.
C. Each person using any skateboard/skating area must wear a shirt and proper safety equipment, including a helmet, elbow pads, and kneepads. All such safety equipment must be functional and protective, properly sized, and designed for the activity being engaged in.
D. No person shall ride, use, or bring into the skateboard/skating area any wheeled device other than a wheeled recreational device. Use of any other wheeled devices including, but not limited to, bicycles, unicycles, go-carts, or wagons is prohibited.
E. No person shall possess or use alcohol, drugs, or tobacco products within a skateboard/skating area.
F. No person shall litter or discard any materials in any skateboard/skating area. All persons using the skateboard/skating area must place any trash they create at or bring to the skateboard/skating area in refuse containers provided by the city. If the city provides no refuse container, each person shall be responsible for removing and disposing of such items in an appropriate manner.
G. No person shall cause graffiti, tagging, or the attachment of any stickers or unauthorized signs in or upon any skateboard/skating area or anywhere in the surrounding park area.
H. No person shall ride, or permit to be ridden, any wheeled recreational device in a skateboard/skating area in a reckless manner or with willful disregard for the safety of persons or property.
I. No person may use a wheelchair in any skateboard/skating area if that person is able to walk.
J. Glass containers and other glass products are prohibited within the skateboard/skating area.
K. No ramps, jumps, or other obstacles may be placed in any skateboard/skating area.
L. The skateboard/skating area shall not be used if any hazardous condition exists, including but not limited to inclement weather, significant cracks, breaks, or other visible irregularities in the skating surface of the skateboard/skating area.
M. Personal stereos, earphones, and headphones are prohibited within any skateboard/skating area.
N. No animals are allowed in any skateboard/skating area.
O. All organized events shall have the written approval of the director of community services, parks, and recreation or his designee.
P. The city is not responsible for any items that are lost or stolen within any skateboard/skating area.
Q. Any person suffering an injury within a skateboard/skating area must promptly report the injury to the City of Chino Risk Management Department.

10.24.090 - Removal.¶
Any person violating any of the provisions of this chapter may be told to leave the skateboard/skating area for a period of forty-eight hours by any city employee or police officer. Failing to leave, or returning within forty-eight hours, shall be a violation punishable as a misdemeanor.

10.24.100 - Signs required.¶
In order to provide reasonable notice to the public, signs referring to this chapter shall be posted in one or more conspicuous areas at or near the entrance to each of the skateboard/skating areas, setting forth the rules and regulations established herein, including prohibited activities, and stating that any person failing to comply with any provisions of this chapter shall be subject to eviction for a period of forty-eight hours, citation, or arrest.

10.24.110 - Permit required.¶
Any person desiring to hold an organized event, profit or non-profit, utilizing a skateboard/skating area shall apply for and receive a permit as required under Section 12.20.020 of the Chino Municipal Code.

10.24.120 - Penalty for violation.¶
A. Any person who violates any of the provisions of this chapter, with the exception of Section 10.24.090, shall be guilty of an infraction punishable pursuant to Section 1.12(B) of this code.
B. Any person who violates Section 10.24.090 shall be guilty of a misdemeanor punishable pursuant to Section 1.12(A) of this code.
