6.30.010 - Establishment of a storm drainage fund.

(a) There is created a storm drainage fund which shall consist of a storm drainage collection account.

(b) All moneys received in payment of the storm drainage collection fees shall be deposited with the city treasurer in the storm drainage fund.

(c) The moneys received into the storm drainage collection account shall be used for storm drainage acquisition, construction, reconstruction, maintenance, operation, administration and management, the payment of bonded debt service and the maintenance of an adequate working reserve for such storm drainage facilities.

6.30.020 - Storm drainage fees.

(a) The city shall prescribe, revise and collect its storm drainage fees by ordinance approved and authorized by a two-thirds vote of the members of the city council, following such notice and public hearing as may be required by Section 5471 et seq. of the State Health & Safety Code, Section 6 of Article XII(D) of the California Constitution, or any successor statutes and other applicable laws.

(b) The property owner of record (or such assignee as designated by such property owner under the rules and regulations of the city as set forth by resolution) of each developed property within the city shall pay to the city an amount equal to a monthly fee of four dollars, or an annual fee to be collected on the tax roll pursuant to Section 5473 of the State Health & Safety Code of forty-eight dollars, for the storm drainage facilities.

(c) Except as set forth otherwise in this section, the rules, regulations, policies and procedures governing the billing, collection, and administration of storm drainage services and fees shall be as set forth in such resolutions as the city council may adopt from time to time by majority vote.
