6.08.010 - New businesses.

(a) Any person, firm or corporation intending to operate any place or business required by this title to have a permit, which is not in existence on the effective date of this code shall before opening or operating such place of business make application to the health officer upon a form provided by such health officer giving the name of the owner or owners, manager or managers thereof, the location, and such other information as the health officer may require for the administration of this code.

(b) This application shall include a signed statement that such applicant will observe the provisions of this code, and all other applicable statutes, ordinances, rules and regulations.

(c) Following receipt of application by the health officer, he shall make or cause to be made an inspection of the premises, and, if the provisions of this code have been complied with, he shall so certify that fact to the applicant and issue a permit to operate, upon a form approved by the health officer; provided, that such permit may be issued by the health officer without making such an inspection if his experience and knowledge of the pemises affords him reasonable assurance of compliance with the provisions of this code.

6.08.020 - Requirements.

(a) No permit to operate a place of business mentioned in Section 6.08.010 (a) shall be issued to any person until all of the provisions of this code and all other applicable statutes, ordinances, rules and regulations shall have been complied with. Any permit issued under the provisions hereof is not transferable from on person, firm or corporation to another person, firm, or corporation or from one location to another.

(b) Every permit issued hereunder shall bear on its face as "effective date," the date upon which said permit shall become effective.

(c) Every permit shall be kept posted in a conspicuous place in or on the establishment, place or business for which the permit is issued.

6.08.030 - Revocation.

If it be determined by the health officer following any investigation or inspection of any place or business required by the provisions of this code to have a permit that the operator, owner or manager has not complied with the provisions of this code, and all other applicable statutes, ordinances, rules and regulations, particularly the health and sanitary laws and regulations, the health officer shall immediately revoke the permit issued to the operator, which grants permission to operate.

6.08.040 - Renewal of permits previously revoked.

The owner, operator, or manager of any place or business required by this title to have a permit, in which the permit to operate has been revoked shall be required to completely correct the condition upon which the health officer based his reason for revoking the permit, and shall be required to make a new application for permit as provided for in Section 6.08.010, in the same manner as for a new place or business. Such applicaton shall include a statement signed by the operator that the condition complained of by the health officer has been completely corrected.

6.08.050 - Annual expiration.

A permit, for which application is made, under the provisions of this code, may be granted at any time during the year, but all permits granted hereunder shall expire on the first day of July following issuance.

6.08.060 - Renewal of expired permits.

The owner, operator or manager of any place or business hereunder required to have a permit, for which the permit to operate is subject to automatic expiration, shall be required to make an application to the health officer for renewal of such permit as provided for in Section 6.08.010, in the same manner as for a new place or business; provided, that such application shall be made prior to the date of expiration of such existing permit, and further provided that if such application is made prior to such date of expiration the existing permit shall remain valid and in effect until such application for renewal of permit has been acted upon by the health officer, and renewal of such permit has been denied, or the new permit has been issued, and the applicant has been notified accordingly.

6.08.070 - Fees.

Every person, firm or corporation applying for a permit or for renewal of a permit previously revoked or for renewal of an expired permit under the provisions of this code shall, at the time of making the application, pay an inspection fee in accordance with the following schedule:

Each perishable food vending machine 5.00 per year
Itinerant food concessions (fairs, circuses, special events and traveling shows):
1—5 days 15.00 per concession
6—11 days 25.00 per concession
Liquid waste haulers, each vehicle 50.00 per year
Public swimming pools 25.00 per year
Each additional pool 10.00 per year
(Pools operated by recreation districts, public schools, and other public districts are exempt.)
Children's camps and boarding schools 25.00 per year
Riding academies and stables 20.00 per year
Manure storage and processing 100.00 per year
Artificial and natural public bathing places 50.00 per year
Refuse collection and hauling companies:
Up to 100 services 25.00/yr. per truck plus 10.00/mo. per truck
101—300 services 50.00/yr. per truck plus 10.00/mo. per truck
301—500 services 100.00/yr. per truck plus 10.00/mo. per truck
Over 500 services 200.00/yr. per truck plus 10.00/mo. per truck

A fifty-percent penalty shall be added to each of the foregoing for failure to make application for yearly renewal within thirty days from the date of expiration or for failure to apply for a permit in the case of a new business or seasonal operation before opening for business.

The foregoing fees shall be paid to the department of environmental health services.

In the case of a new business requiring a permit under this section, or a transfer of ownership of an existing business, fees shall be prorated on a quarterly basis for the remaining part of the permit year. No fee shall be reduced or prorated to less than five dollars.

6.08.080 - Additional fees.

Fees for services provided by the department of environmental health services in the city and not covered under Section 6.08.070 shall be the same as those currently found in Title 1, Division 6, Chapter 2 of the county code as adopted and hereinafter amended by the board of supervisors of San Bernardino County or by the appropriate department.
