6.16.010 - Conformance to agricultural code standards.

It is unlawful for any person, firm, or corporation to sell, offer for sale, distribute or possess for sale or distribution, any milk or cream for human consumption as milk or cream unless it conforms to the standards and requirements for the production of milk or cream provided by Division 15 of the Agricultural Code of the state.

6.16.020 - Permit—Application.

It is unlawful for any person, firm, or corporation, or agent or employee of the aforesaid, to bring or receive into the city, for sale or to sell, offer for sale, or have in possession for the purpose of sale or distribution for consumption within the city, any milk or cream, unless such person, firm or corporation shall first have obtained a permit so to do from the health officer of the city, as provided in Section 33222 of the Agricultural Code, and the rules and regulations for its enforcement promulgated by the Director of Agriculture. Said permit shall be applied for in writing and upon a form supplied for that purpose by the health officer, and all information required and so indicated upon said form shall be given by the applicant in writing therein.

6.16.030 - Fees.

Every person, firm, or corporation applying for a permit under the provisions of this chapter shall at the time of making application for such permit, pay an inspection fee to the health department of the city in accordance with the following schedule:

Milk distributor $10.00
Milk producer-distributor 25.00
Milk depot-distributor 25.00
Milk processing-distributor 25.00

All moneys received as inspection fees under provisions of this chapter shall be paid to the city treasurer and placed in the city treasury. A permit for which application is made under the provisions of this title may be granted at any time during the year, but any permit granted thereunder shall expire on the thirty-first day of December of the year in which the same is granted, and the same must be renewed on or before January first of the following year.

6.16.040 - Penalty fee.

Every person, firm or corporation having a permit under this chapter and who fails to apply for a renewal thereof within the time prescribed in Section 6.16.030, shall, in addition to the required fee, pay a penalty fee in the amount of twenty-five percent of the fee.

6.16.050 - Revocation of permit.

The health officer, upon notice and hearing, and upon the findings that the standards of grading and the requirements for the production of milk and cream established in this chapter have been violated, may revoke such permit.

6.16.060 - Milk quality requirements.

No milk or cream, intended for consumption within the city, shall be sold or offered for sale which is not produced on dairies that score at least seventy on the form provided for dairy inspection by the Department of Agriculture of the state; no milk sold or offered for sale for consumption within the city shall have a butterfat content of less than three and five-tenths percent by volume as determined by the Babcock test.
