Chapter 17.30 — LOT LINE ADJUSTMENTS

17.30.010 - Title and purpose.

The purpose of Section 17.30.010 through Section 17.30.040, inclusive, is to create and establish regulations, standards and procedures for lot line adjustments. Such adjustments shall be for minor shifting of existing lot lines. This chapter is not intended for major reconfiguration of existing parcels nor the creation of new parcels.

17.30.020 - Submission of lot line adjustment application.

The lot line adjustment application shall meet the following standards:

A.

Map.

1.

The map shall be prepared by a licensed land surveyor or registered civil engineer;

The map shall be legibly drawn to a convenient engineer's scale;

All properties involved shall be legally identified and the names of all property owners shall be shown;

The map shall show the portion of the lot that is going to be transferred, and each lot after the lot line adjustment is made;

5.

All structures, improvements, drainage facilities, utilities, dedications, rights-of-way and easements shall be shown;

6.

The map scale and a north arrow shall be shown.

B.

The following additional information shall be included in the application, unless exempted by the public works director:

1.

Legal description and closure calculation prepared by a licensed land surveyor or registered civil engineer for the portion of the lot that is going to be transferred and each lot after the lot line adjustment is made;

2.

The application as-built grading and drainage plan;

3.

The reasons for the lot line adjustment;

4.

Current title report;

5.

Letter from the licensed land surveyor or registered civil engineer stating the property corners or angle points for the proposed lot lines have been monumented with three-quarter-inch by twenty-four inch long rebar and RCE tag;

6.

Grant deed to the city if the lot line adjustment requires dedication to the city;

7.

Grant deed for the city if city land will be conveyed.

C.

The fee for lot line adjustment applications, as adopted by city council resolution, shall accompany the application. This fee shall include the cost of issuing and recording the notice of lot line adjustment.

17.30.030 - Lot line adjustment process.

A.

The lot line adjustment application shall be submitted to the planning division. Within ten days of receiving the application, the development services director shall determine whether the lot line adjustment is minor in nature. If the development services director determines the adjustment is major, then the applicant shall be required to comply with Chapters 15.08 or 15.14 of the Vallejo Municipal Code.

B.

Within ten days of receiving the application, the planning division shall inform the applicant whether the application is complete and accepted for filing. If the application is incomplete, the planning division shall state in what respect the application is incomplete.

C.

After an application is found to be complete, the planning division shall determine whether the lot line adjustment conforms to the general plan, building codes and the zoning ordinance. Once this determination has been made, the application shall be forwarded to other agencies with easements on any of the properties affected by the lot line adjustment and to the public works department for approval.

D.

The application will then be sent to the public works department for preparation of a notice of a minor lot line adjustment. Upon preparation of the notice, the city shall cause it to be recorded with the county recorder.

17.30.040 - Right of appeal.

The applicant shall have the same right of appeal as described in Sections 15.08.070 and 15.08.080 of the Vallejo Municipal Code.
