Chapter 15.04 — DEFINITIONS

15.04.010 - Building ordinance.¶
"Building ordinance" means Title 12, Building and Construction, of the Vallejo Municipal Code, as from time to time amended.

15.04.020 - City.
"City" means the city of Vallejo, Solano County, California.

15.04.030 - City attorney.
"City attorney" means the city attorney of the city of Vallejo or his or her designee.

15.04.040 - City clerk.
"City clerk" means the city clerk of the city of Vallejo or his or her designee.

15.04.050 - City council.
"City council" means the city council of the city of Vallejo.

15.04.060 - City engineer.
"City engineer" means the city engineer of the city of Vallejo or his or her designee.

15.04.070 - City finance director.
"City finance director" means the city finance director of the city of Vallejo or his or her designee.

15.04.080 - City manager.
"City manager" means the city manager of the city of Vallejo or his or her designee.

15.04.090 - Commission.
"Commission" means the planning commission of the city of Vallejo.

15.04.100 - County.
"County" means the County of Solano, California.

15.04.110 - Design.
"Design means:
A.
Street alignments, grades and widths;
B.
Drainage and sanitary facilities and utilities, including alignments and grades thereof;
C.
Location and size of all required easements and rights-of-way;
D.
Fire roads and firebreaks;
E.
Lot size and configuration;
F.
Traffic access;
G.
Grading;
H.
Land to be dedicated for park and recreational or recreational purposes; and
I.
Such other specific physical requirements in the plan and configuration of the entire subdivision as may be necessary to ensure consistency with, or implementation of, the general plan or any applicable specific plan.

15.04.120 - Development.
"Development" means the uses to which the land which is the subject of a map shall be put, the buildings to be constructed on it, and all alterations of the land and construction incident thereto.

15.04.130 - Development services department.
"Development services department" means the development services department of the city of Vallejo.

15.04.140 - Development services director.
"Development services director" means the development services director of the city of Vallejo or his or her designee.

15.04.150 - Final map.
"Final map" means a map that delineates the final division of land into five or more land, condominium or community apartment parcels with required dedications and/or improvements, except as discussed in Section 15.06.110(A).

15.04.160 - General plan.
"General plan" means the Vallejo General Plan, as from time to time amended.

15.04.170 - Government Code.
"Government Code" shall mean the Government Code of the state of California.

15.04.180 - Improvement.
"Improvement" means:
A.
Any street work and utilities to be installed, or agreed to be installed, by the subdivider on the land to be used for public or private streets, highways, ways, and easements, as are necessary for the general use of the lot owners in the subdivision and local neighborhood traffic and drainage needs as a condition precedent to the approval and acceptance of the final map thereof;
B.
Any other specific improvements or types of improvements, the installation of which, either by the subdivider, by public agencies, by private utilities, by any other entity approved by the city, or by a combination thereof, is necessary to ensure consistency with, or implementation of, the general plan or any applicable specific plan.

15.04.190 - Merger.
"Merger" means the joining of two or more contiguous parcels of land under one ownership into one parcel.

15.04.200 - Owner.
"Owner" is the individual, firm, association, syndicate, copartnership, corporation or other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain subdivision proceedings under this title; and while used in the masculine gender and singular number, it means the feminine and neuter gender and plural number whenever required.

15.04.210 - Parcel map.
"Parcel map" means a map made for the purpose of showing the design and improvement of a proposed subdivision when:
A.
The subdivision contains less than five lots;
B.
The land before division contains less than five acres; each parcel the subdivision creates abuts a
maintained public street or highway; and no dedications or improvements by the development services director as a condition of approval;
C.
Each parcel the subdivision creates has a gross area of at least twenty acres or more and has an approved access to a maintained public street or highway;
D.
The land consists of parcels having approved access to a public street or highway; is zoned for industrial or commercial development; and has the governing body street alignment and width approval; or
E.
Each parcel the subdivision creates has a gross area of at least forty acres, or is at least a quarter of a quarter section.

15.04.220 - Planning division.
"Planning division" means the planning division of the development services department.

15.04.230 - Planning manager.
"Planning manager" means the planning manager of the planning division.

15.04.240 - Public works director.
"Public works director" means the public works director of the city of Vallejo or his or her designee.

15.04.250 - Subdivider.¶
"Subdivider" means a person, firm, corporation, partnership or association who proposes to divide, divides or causes to be divided real property into a subdivision for himself, herself, or others; except that employees and consultants of such person or entities, acting in such capacity, are not subdividers.

15.04.260 - Subdivision.
"Subdivision" means the division, by any subdivider, of any unit or units of improved or unimproved land, or any portion thereof, shown on the latest equalized county assessment roll as a unit or as contiguous units, for the purpose of sale, lease or financing, whether immediate or future except for leases of agricultural
land for agricultural purposes. Property shall be considered as contiguous units, even if it is separated by roads, streets, utility easements or railroad rights-of-way. "Subdivision" includes a condominium project, as defined in Section 1350 of the Civil Code, a community apartment project, as defined in Section 11004 of the Business and Professions Code, or the conversion of five or more existing dwelling units to a stock cooperative, as defined in Section 11003.2 of the Business and Professions Code. As used in this section, "agricultural purposes" means the cultivation of food or fiber or the grazing or pasturing of livestock.

15.04.270 - Subdivision Map Act.
"Subdivision Map Act" means the Subdivision Map Act of the State of California (Government Code, Sections 66410 et seq.).

15.04.280 - Tentative map.
"Tentative map" means a map made for the purpose of showing the design and improvement of a proposed subdivision and the existing conditions in and around it and need not be based upon an accurate or detailed final survey of the property.

15.04.290 - Vesting tentative map.
"Vesting tentative map" refers to a map which meets the requirements of Chapter 15.10, as well as the Subdivision Map Act.

15.04.300 - Zoning ordinance.¶
"Zoning ordinance" means Title 16, Zoning, of the Vallejo Municipal Code, as from time to time amended.
