Whenever any resolution of the City Council, initiated by citizen petition or by the City, designates and describes any street or portion thereof as a street or in any parking facility operated by the City, the parking or standing on which shall be restricted to vehicles displaying a parking permit issued by the City, the City Traffic Engineer shall erect and maintain appropriate signs on those streets or portions thereof affected by such restriction. § 10.38.020. Unlawful parking.

No person shall park or leave standing on a street designated pursuant to Section 10.38.010 or a City operated parking facility or portion thereof any vehicle unless such vehicle has displayed thereon an appropriate permit issued by the City which entitles the holder thereof to preferential parking privileges on the street or portion thereof in question. § 10.38.030. Unlawful acts.

It is unlawful:

  • A. For any person to falsely represent him or herself as eligible for a parking permit or to furnish false information in an application therefor;

  • B. For any person holding a valid parking permit issued pursuant hereto to permit use or display of or to use or display such permit on a motor vehicle other than that for which the permit was issued;

  • C. For any person to copy, reproduce or otherwise bring into existence a facsimile or counterfeit parking permit or permits without written authorization from the Finance Department;

  • D. For any person to knowingly use or display a facsimile, altered or counterfeit parking permit in order to evade time limitations on parking applicable in a preferential residential parking permit area;

  • E. For any person holding a valid parking permit issued pursuant to this chapter to sell, give or exchange the permit to any other person.

By parking a vehicle on a City street or in a parking facility operated by the City and marked as restricted to vehicles displaying a City issued permit, the owner, operator or person in charge of such vehicle shall be deemed to have consented to the provisions of subsections A, B, C, D and E. The issuance and review of notices of parking violation and delinquent parking violation, and the liability for and payment and collection of parking violation penalties, shall be governed by Sections 40200 et seq., of the California Vehicle Code.

§ 10.38.040. Authority.

The regulations imposed by this chapter and any resolution of the City Council adopted pursuant thereto are enacted pursuant to the authority of the State of California Vehicle Code Section 22507.

§ 10.38.050. Installation and maintenance of parking revenue equipment.

The City Traffic Engineer is authorized and directed to install, maintain and operate the necessary parking revenue equipment in areas designated by the City Council as fee parking areas, subject to such exceptions as may be approved by City Council resolution, and in such offstreet parking facilities operated by the City as shall be specified by council resolution, for the purpose of, and in such numbers, and at such places, and for such days and hours, as to provide for the efficient control and regulation of the parking of vehicles therein. § 10.38.060. Parking time limits.

The Economic and Community Development Director is authorized and directed to establish maximum time limits for both fee and non-fee parking spaces located within the station district, the high school area, the civic center area, and adjacent areas, all as specifically described by resolution of the City Council, in order to facilitate long and short-term visitor access to destinations within the downtown parking zone. The maximum time limit, days and hours of operation, parking rate, and payments accepted by parking revenue equipment shall be indicated on said parking revenue equipment.

§ 10.38.070. Rates charged for use of parking spaces.

  • A. The rates for use of parking spaces in locations designated by the City Council as fee parking areas shall be established by City Council resolution.

  • B. The rates for use of parking spaces located in parking lots designated by the City Council as fee parking lots shall be established by City Council resolution.

§ 10.38.080. Curb or street lines or markings.

The City Traffic Engineer shall have lines or markings painted or placed upon curbs and streets to designate parking spaces where fees will be collected by parking revenue equipment, and shall have lines or markings painted or placed in off-street parking locations. Each vehicle parked in areas lined and marked in said fashion shall park within the lines or markings so established. It is unlawful to park a vehicle of such size or in such a position that the same shall not be entirely within the space designated by such lines or markings. (Ord. 727-10 § 6, 2010)

§ 10.38.090. Unlawful parking in on-street parking spaces.

It is unlawful for any person to cause or permit any vehicle registered in his or her name or operated by him or her to be parked continuously in any parking space equipped with parking revenue equipment, during days and hours designated by resolution, for more than the maximum period of time indicated on said parking revenue equipment, or any time during which signs or information posted on parking revenue equipment indicates that the space is illegally in use, except during the time necessary to make payment at the parking revenue equipment, and excepting also on Sunday and on days designated by the City Council as parking fee holidays. § 10.38.100. Parking fee holidays.

Parking fees will not be due or collected on the following holidays as designated by the United States and State of California: New Year's Day, Martin Luther King Day, Presidents' Day, Caesar Chavez Day, Memorial Day, Independence Day, Labor Day, Veterans' Day, Thanksgiving Day, the day after Thanksgiving and Christmas Day. The City Council may designate days of observance of some of these holidays when City offices are closed and some City services are not provided. In such instances the parking holiday shall be the actual Federal or state holiday, not the day of City observance. (Ord. 727-10 § 6, 2010)

§ 10.38.110. Unlawful parking in off-street parking spaces.

  • A. It is unlawful for any person to cause or permit any vehicle registered in his or her name or operated by him or her to be parked continuously in any fee parking space within any ungated off-street parking facility operated by the City during the posted days and hours of operation of that facility without having paid parking fees as posted within said facility during posted days and hours of facility operation except for time necessary to make payment at the parking revenue equipment.

  • B. It is unlawful for any person to circumvent, displace, break, vandalize, or overcome control mechanisms in any off-street parking facility operated by the City in order to avoid payment of parking fees. The issuance and review of notices of parking violation and delinquent parking violation, and the liability for and payment and collection of parking violation penalties, shall be governed by Sections 40200 et seq., of the California Vehicle Code.

§ 10.38.120. Overnight parking prohibited—No parking times.

  • A. It is unlawful for any person to cause or permit any vehicle registered in his or her name or operated by him or her to be parked in any parking space in an off-street parking facility operated by the City in excess of twenty-four consecutive hours without that person having obtained from the City an overnight parking permit. In the event a vehicle is so left parked or standing in a City parking facility for twenty-four or more consecutive hours with no overnight parking permit, any member of the City Police Department, or any City employee assigned to the enforcement of parking laws and regulations, may remove the vehicle from parking facility in the manner and subject to the requirements of the California Vehicle Code.

  • B. The Economic and Community Development Director is authorized and directed to designate times when no parking shall be allowed in off-street parking facilities operated by the City. It is unlawful for any person to cause or permit any vehicle registered in his or her name or operated by him or her to be parked in a parking space in an offstreet parking facility operated by the City at times when no parking has been so designated for such facility.

§ 10.38.130. Exclusive use of parking spaces.

Temporary utilization of parking spaces located in streets designated as fee parking or offstreet fee parking facilities operated by the City, with the deposit of payment and for a period of time longer than the maximum time limit of said parking space, may be granted by the City upon application for such permission. The application shall be submitted in writing to the Economic and Community Development Director and shall provide substantial need for temporarily closing off these spaces for a stated duration of time. The applicant for temporary utilization of such parking spaces shall pay the City for use of those parking spaces at four times the posted maximum daily parking rate for each day of use. Upon receipt of these payments, signs will be posted on said parking spaces. This provision shall not permit anyone other than the applicant to occupy a parking space during a posted no-parking period. (Ord. 727-10 § 6, 2010)

§ 10.38.140. Deposit of payment required.

When any vehicle is parked in any parking space for use of which a fee is required as provided in accordance with the provisions of this chapter, the operator of the vehicle upon parking shall, and it is unlawful to fail to, deposit immediately United States coins, currency, or other such payment that is available and/or operational for fee parking spaces located within the City and in off-street parking facilities operated by the City where fees for parking have been established. § 10.38.150. Notice of parking violation.

It shall be the duty of each police officer or employee of the Police Department as designated by the Police Chief, and any City employee assigned to enforce parking laws and regulations, to observe any vehicles that are parked in violation of this chapter or the California Vehicle Code, and to issue and attach to such vehicles a notice of parking violation as provided by law.
