§ 8.24.300. Right of hearing.

Any person whose application for permit has been denied, or granted conditionally, or whose permit has been suspended or revoked, or against whose property a notice of violation has been recorded, may appeal to the city council, in writing, within 15 days after written notice of any such denial, conditional granting, suspension, revocation, or recording is mailed to the applicant/permittee. Such appeal shall specify the grounds upon which it is taken, and shall be accompanied by a filing fee established pursuant to Section 8.24.070 of this chapter. The city clerk shall set such appeal for

hearing at the earliest practicable time, and shall notify the appellant and the director, in writing, of the time so set at least 15 days prior to the hearing. (Prior code § 24A.30)

§ 8.24.310. Appeal—Procedure.

  • A. The evidence before the city council shall consist of the records in the director's files and any other relevant evidence which, in the judgment of the city council, should be considered to effectuate and implement the policies of this chapter.

  • B. The city council may continue the hearing from time to time; provided, however, that the decision of the city council shall be rendered no later than 45 days after the date first scheduled for the appeal.

§ 8.24.320. Action by city council.

After such hearing on the appeal, the city council may reverse or affirm, wholly or in part, or may modify the order or determination appealed from. (Prior code § 24A.32)
