SEC. 5.3-1. CREATED.¶
The City hereby establishes the State Legislation Council (“State Legislation Council”) as an Advisory Body as defined in Section 5.1- 1. (Added as Sec. 5.5 by Ord. No. 8308 (1939), Sec. 1; amended and redesignated by Ord. 99-26, File No. 260217, App. 5/29/2026, Eff. 6/29/2026)
SEC. 5.3-2. DUTY TO STUDY PROPOSALS AND MAKE RECOMMENDATIONS.¶
Any proposal for the enactment of legislation affecting the interests or welfare of the City, which is pending before the State Legislature or which may be considered for presentation to the Legislature, shall be initiated by or referred to the State Legislation Council for study and recommendation that the City endorse, oppose or remain neutral with respect to such proposals. SEC. 5.3-3. COMPOSITION.¶
The members of the State Legislation Council shall be the Mayor, who shall act as chair, the City Attorney, two members of the Board of Supervisors to be designated by the President of the Board of Supervisors, the Controller, the Assessor and the Treasurer. Each of the above-named members may designate a duly authorized representative to attend the meetings in their absence. SEC. 5.3-4. REPORT OF PROCEEDINGS.¶
A report of the proceedings of each meeting of the State Legislation Council and the recommendations made by the State Legislation Council shall be submitted to the Board of Supervisors not later than the next regular business day following such meeting. SEC. 5.3-5. ACTION BY COMMITTEE1 IN ABSENCE OF ACTION BY BOARD OF SUPERVISORS.¶
The Board of Supervisors, by resolution, may take such action upon any recommendation of the State Legislation Council as it deems necessary or desirable, but in the absence of any such action by the Board of Supervisors, the State Legislative Representative may take suitable action consistent with any such recommendation of the State Legislation Council as the policy of the City. SEC. 5.3-6. ESTABLISHMENT OF POLICY WITHOUT REFERENCE TO COUNCIL.¶
Nothing contained in this Article shall preclude the Board of Supervisors from establishing policy with respect to any matter of proposed state legislation, without reference to or report from the State Legislation Council, if in the Board’s discretion such reference or report is inadvisable or inexpedient.
