No person shall erect, construct or install any structure or facility over, under, upon or across any street, alley, sidewalk, street right-of-way or other public property without first having obtained a permit from the City Council, except that if the erection, construction or installation shall not exceed a period of ten consecutive days, the Director of Public Works may grant the permit.

§ 19.7-1 FIVE-YEAR MORATORIUM ON ROADWAY PENETRATIONS.¶
No person shall trench, pavement cut, vertical bore, or perform any other surface disturbances within public streets that have been newly paved, reconstructed, or resurfaced within a preceding five-year period. The five-year moratorium takes effect immediately upon city acceptance of pavement improvements and is intended to preserve the structural integrity, longevity, and appearance of newly improved streets. Exemptions to this moratorium may be granted by the City Engineer or Public Works Director only under specific circumstances, such as emergency utility repairs, essential utility service connections, or projects deemed to be in the public interest. All work performed under an approved exemption shall adhere strictly to the procedures and standards outlined in the Five-Year Moratorium Street Cut Replacement Guidelines, which are adopted by reference as part of this section. These guidelines govern permitting requirements, construction methods, trench restoration standards, and enforcement protocols. Violations may result in penalties, permit revocation, or a requirement for full-width pavement restoration at the responsible party's expense. The guidelines are maintained by the Public Works Department and may be amended administratively to reflect current best practices and city standards.
