Sec. 10.25.001. - Declaration of intent.

The city council finds and declares that there are privately owned and maintained off-street parking facilities within the city that are generally held open for use by the public for handicapped vehicular parking.

Sec. 10.25.010. - Establishment of parking spaces.

The police chief, subject to prior approval of the city manager, is authorized to locate and establish parking spaces upon city streets for the purpose of providing on-street parking for exclusive use by persons with disabilities. Such handicapped parking spaces shall be indicated by blue paint on the curb or edge of the paved portion of the street adjacent to each such space and sign consisting of a profile view of a wheelchair, with occupant in white on a blue background, which indicates that only vehicles displaying distinguishing license plates or placards issued for persons with disabilities are permitted to park.

Sec. 10.25.020. - Public parking; enforcement.

(a) It is unlawful for any person to park or leave standing any vehicle in a stall or space designated for persons with disabilities.

(b) The police chief, or his authorized representative, is authorized and empowered to enforce parking regulations as adopted relating to parking spaces reserved for handicapped persons and to issue parking control notices relating thereto.

(c) When the police chief places and maintains or causes to be placed and maintained authorized signs or markings on, in or about public parking spaces designating said spaces to be available and reserved for vehicular parking by persons with disabilities only, no vehicle other than those identified with distinguishing license plate or placard issued to or for disabled persons by the department of motor vehicles shall be parked in any such parking space so marked, signed or designated.

(d) The sign shall contain a warning that vehicles parked in such designated spaces not in compliance with this section are subject to removal at the owner's expense. Said sign shall include reference to this Code section.

Sec. 10.25.030. - Private parking; enforcement.

(a) No ordinance or resolution enacted shall apply to any off-street parking facility described herein unless the owner or operator has caused to be posted in a conspicuous place at each entrance to such off-street parking facility a notice not less than 17 by 22 inches in size with lettering not less than one inch in height, to the effect that such off-street parking facility is subject to public traffic regulations and control.

(b) The city shall not be required to provide patrol or enforce any provisions of this Code on any privately owned and maintained off-street parking facility applicable to private property other than as set forth herein.

Sec. 10.25.040. - Violation; penalty.

A violation of this section is an infraction and subject to a $25.00 fine for a first offense, and for subsequent offenses subject to the provisions of section 42001 of the California Vehicle Code.
